Licensing Program Analysts (LPA) Odom conducted an unannounced complaint investigation. This is a continuation of the investigation initiated on 10/06/2021. Upon arrival LPA met with Director, Jaime Alls, to deliver complaint findings. At 2:40pm Director guided LPA on a tour of the facility. LPA took census, there were a total of 35 school age children in Y-1 classroom with 3 staff members.
A review of staff records on this date indicated that all facility staff or other individuals who required caregiver background checks have received criminal record and child abuse index clearances or exemptions.

The Department received a complaint on 10/04/2021 alleging (1) parent was denied access to child’s records, (2) facility staff did not communicate with parent regarding day care child’s safety issues, (3) day care child is being bullied by other children while in care, (4) day care children are being released from the facility without parental signatures, and (5) facility does not provide day care children a safe environment.

The complainant party (CP) indicated the childcare does not provide copies of attendance records, sign in and out sheet, or emergency contact information. CP stated, the childcare does not have a formal process to identify what days child #1 (C1) is scheduled to attend the childcare. On two different occasions C1 was released from the elementary school instead of being taken to the childcare. CP stated, C1 is being bullied at school and childcare by older children.

During the investigation LPA Odom interviewed complaining party, 2 staff members, 1 Parent and 1 child. LPA obtained copies of the Children’s Roster, personnel records, childcare policies, e-mail threads, court orders, attendance sheets, sign-in and sign-out sheets, and weekly roster.

During an interview on 10/06/2021 and 11/29/2021, the Director (S1) stated, the childcare never received copies of the court orders for custody. According to an e-mail thread, on 10/2/21 the childcare sent an e-mail to CP informing them that according to the Parent Handbook policies, “any custodial parent requesting copies of any records must do so by court order”. CP has not provided a court order to obtain the documents requested.

S1 stated, C1 does not attend the childcare everyday only when parent (P1) has custody, P1 will send a weekly e-mail to the school and childcare indicating the days C1 will attend the childcare. S1 stated, the childcare pick-up process to the childcare is staff will pick-up the kinder garden children only, and grades 1st to 5th walk to the childcare on their own. S1 stated, at 2:05pm K-3rd grade children will arrive to the childcare and staff will check them in electronically, and staff also have a weekly log to monitor which children will be attending the childcare that day. If a child does not arrive in within 5-10 minutes staff will call parents immediately. S1 stated, the childcare is in the back of the elementary school crossing the playground, the entire school is completely fenced, and the children do not leave the school or childcare unless released by the childcare. S1 stated, parent sign-out method is each parent has a unique electronic code and they can also sigh out manually.

S1 stated, the childcare has a zero tolerance policy on bulling, the childcare has implemented a program called, “Character counts” that teaches children about having good character including responsibility and being kind to each other.

When a child demonstrated one of the characters, they will be rewarded with a punch card to be redeem for a prize. C1 has never told any staff that they have been bullied by other children in care.

Staff #2 (S2) was interviewed on 12/3/21. S2 stated, the childcare has a zero tolerance on bulling. S2 stated, they have never observed another child bulling C1 in the childcare, on occasion a child being mean but, S2 will speak with both children and have the children apologize. S2 stated, S1 is very hands on with the children and if there is an incident on bulling S1 will speak with the children and the parents.

P1 was interviewed on 11/30/21. P1 stated, C1’s childcare schedule varies throughout the week, every week they will e-mail the school and childcare center on the days C1 will be attending the childcare. P1 stated, they will also remind C1 which day it is, and C1 understands they are to attend the childcare that day. P1 stated, they sign out C1 through an electronic method with a unique code that is provided to each person. P1 stated, the childcare is great, and safe the staff is very communicative with the parents and the elementary school. P1 stated C1 has never told P1 they have been bullied by children at the childcare, and that S1 would have informed them if anything would have happened at the childcare. P1 stated, the elementary school investigated a possible bulling case but, it was determined the allegation was false.

LPA Odom interviewed child#1 (C1) on 12/3/21. C1 disclosed they have not been bullied by another child in care. They have their best friends in care and they like the childcare because they get to play tag and on the playground. LPA asked C1 if they knew what a bully was, C1 stated, it’s a kid that’s mean and they say bad words.

Based on LPA’s facility inspection, observations, interviews conducted with complainant party, director, staff, parent, child and records reviewed it was determined there was insufficient evidence that CP (1) was denied access to child’s records, (2) facility staff did not communicate with parent regarding day care child’s safety issues, (3) C1 is being bullied by other children while in care, (4) day care children are being released from the facility without parental signatures, and (5) facility does not provide day care children a safe environment. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are Unsubstantiated.

Exit interview was conducted with Director, Jaime Alls. Notice of Site Visit was posted during the visit. Director was informed that the notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. Director was provided a copy of their appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights.
