On 06/06/2022, Licensing Program Analyst (LPA) Tran conducted an in-person inspection to deliver the finding regarding the above complaint allegation. LPA Tran met with Director Fazreen Shariff. The Covid-19 Emergency Response questionnaires were asked. A tour around the facility was conducted, and a census was taken. Observed at the time of the visit was a total of 39 preschool children and 10 staff members. A review of staff criminal clearance records on this date indicated that all facility staff or other individuals who required caregiver background checks have received criminal record and child abuse index clearances or exemptions.

On 03/14/2022, the Regional Office received allegation regarding facility humiliated child in front of child's peers. Reporting Party reported the teacher took a photo of a child with runny nose. RP stated that photo was taken in front of all the other children in the classroom causing child to be humiliated.

During investigation, LPA Tran interviewed 9 staff, 12 children and 5 parents.

During staff interviews, 9 out of 9 interviewed staff denied that they have or have witnessed any staff at the facility, ever taken pictures of the children with the intention to humiliate the children. Teachers stated that they would only take picture of the child with parents' permission and use the picture for communication purposes with the parents.

During children interviews, 6 out of 12 children qualified for the interviews, and 6 out of 6 interviewed children denied witnessing any teacher taking photos of them or other children to make them feel bad.

During parents interviews, 5 out of 5 interviewed parents have no concerns related to the allegation. They are happy with the services the facility is providing for their child/children.

Based on the interviews conducted with 9 staffs, 6 children and 5 parents, there is insufficient evidence to corroborate the allegation that facility humiliated child in front of peers. Although the allegation may have happened or are valid, there is not a preponderance of evidence to prove that facility humiliated child in front of peers did or did not occur, therefore the allegation that facility humiliated child in front of peers is UNSUBSTANTIATED.

Appeal Rights were discussed. The facility representative was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. First level appeal is to Regional Manager, address is above on the report. A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with Director Fazreen Shariff.

During the investigation, LPA Tran reviewed children's file and obtained facility Parent Handbook.

During record review of children's file and facility Parent Handbook, LPA Tran found that, although, the facility did obtain a consent form from parents to take picture of their child, the Consent form stated that parents gave permission for the school to use child photographs and video for the school's promotional purposes and the form was dated for the school year of 2020-2021.

Based on record reviews of child's file and Parent Handbook, the preponderance of evidence standard has been met, therefore the above allegation that facility did not obtain consent to take picture of child is found to be SUBSTANTIATED. California Code of Regulations, Title 22 Division 12 Chapter 1, Section 101219 (b)(2) Admission Agreements is being cited on the attached LIC 9099D.

Appeal Rights and deficiency were discussed. The facility representative was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. First level appeal is to Regional Manager, address is above on the report. Facility Director stated she would submit an updated Parent Handbook, which will include detailed purposes of using the children's photo; and an updated Consent form which will obtain parents' permission for school to take picture of the children while in care and specify the use of the children's photo.

Based on record review of children’s file and facility’s Parent Handbook, the consent form stated parents gave permision for the school to use child photographs and video for the school's promotional purposes and the form was dated for the school year of 2020-2021.

This poses a potential risk to the health, safety or personal rights of the children in care.
