On 03/07/2023 Licensing Program Analyst (LPA), Stella Gutierrez made an unannounced visit to the facility for the purpose of a self reported incident that occurred at the facility on 02/28/2023. LPA was met by the Alma Erwin, assistant director who was explained for the reason for today's visit. LPA observed 14 preschool staff and 63 preschool age children upon arrival.

A review of the Facility Personnel Report Summary conducted on 03/07/2023 indicates all facility staff or other individuals who required caregiver background checks have received criminal record and child abuse index clearances or exemptions.

The assistant director was reminded that all adults 18 and over, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

There was a self reported incident received on 03/03/2023 at the CCLD office via phone call regarding an incident that occurred with Child #1 and 2 Staff (Staff #1 and Staff #2) of a child being left alone without an adult present on the playground of the facility. The self reported incident statement stated that the facility S1 and S2 did not use the facility's 3 point check system protocol which resulted in a lack of supervision of C1.
On 02/28/2023 it was revealed that C1 hid behind the playground structure when S1 and S2 transitioned 13 other children inside the classroom from the playground area of the facility. During today's inspection LPA observed the play ground to be fenced and safe. An interview conducted with the facility assistant director stated that S1 was written up for rolL calling in 04/2022 and was provided a warning. S1 common procatice was to do roll calling in their head. Due to the recent incident S1 and S2 were both terminated on 03/01/2023 based on an internal investigation by the facility of the 2 staff's negligence of following the facility protocol of the 3 point check system protect the children health and safety.

During today, LPA observed how the roll call is done by Staff #3 from the transition from the playground back inside the facility. LPA observed the S3 have the children line up. S3 then called out each child's name and matched the name to the face while checking the child's name off on a roll sheet provided on a clip board.

The facility had a staff training for the facility staff on 03/02/2023 to review accountability of roll taking procedures to ensure the protocol is followed by all staff. The director was informed that the training, meeting should be a common practice and the staff provided reminders throughout the year to ensure the procedure is followed.

Based on LPAs record review and interview the following violation was observed is being cited in accordance with California Code of Regulations, Title 22, Division 12, Chapter 1, Section 101229(a)(1), 1 Type A is being cited on the attached LIC 809D.

LPA Gutierrez informed the facility Assistant Director, Alma Erwin that this report dated 03/07/2023 documents 1 Type A citation. A Type A citation shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care. Also, LPA Gutierrez informed the assistant director to provide a copy of this licensing report dated 03/07/2023 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

Exit interview conducted and report was reviewed with the Alma Erwin, Assistant Director. Appeal Rights and deficiencies were discussed. The facility representative was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days.

A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

On 03/02/2023 a staff meeting was held with all staff addressing the accountability of the roll taking protocal at the facility. LPA observed an effective roll call done by S3 during today's inspection, Type A cleared during today's visit.

This regualtion was not met as evidence by statements of a self reported incident and interview conducted on 03/07/2023 by LPA that a child was left alone on the playground at the facility without adult supervision which included a visual observations. This poses an risk to the children safety while in care. A copy of this regualtion was provided today.
