On 12/11/2023 Licensing Program Analyst (LPA) Anna Chan conducted an unannounced Complaint investigation inspection. This is a continuation of the investigation initiated on 10/13/2023. Upon arrival, the LPA met with Director Stacey Ginesi and informed the director of the purpose of the visit. LPA was lead on walk through of the facility by the director and a census was taken. LPA observed 78 preschool children and 18 staff.

A review of the Facility Personnel Report Summary shows all facility staff or individuals who require caregiver background checks have received a criminal record clearance and a child abuse index clearance or an exemption clearance.

Director stated she will send a copy of communication with parents re behavior and reward system. Director stated staff will have training on Personal Rights. Per Director, she will email agenda and each staff signature on the agenda to LPA by POC due date.

Based on interviews with staff, tickets are taken away from children when they do unkind to others or does not follow directions. And S2 admittedly stated she says "you can do better next time" "next time color the white spaces" to children. S3 confirmed she has heard S2 utter "you can do better next time"
This is a potential risk to personal rights of children in care

The Department received a complaint on 10/09/2023 alleging (1) Staff inappropriately disciplined day-care children (2) Staff made inappropriate comments towards day-care child. It was alleged that staff take away award tickets given to children for use in the classroom store to buy prizes as a discipline measure. It was also alleged that staff demean children by telling uttering inappropriate comments to children.

Interview with the complainant: On 10/9/2023, the LPA called the reporting party (RP), according to the interview, RP stated that her child does not want to go back to school because of teachers taking tickets from them. And RP stated that her child said, her teacher comments that teacher does not like her coloring.

Interview with staff: On 10/13/2023 LPA interviewed two (2) and 11/09/2023 interviewed our (4) staff at the facility regarding above allegations. All 3 staff have the same statement when it comes to ticket rewards for the class. Tickets are taken away from children if they do something unkind against others, or when they do not follow classroom rules. Tickets are earned back right away when children do show good behavior. Regarding the second allegation, 3 staff interviewed were staff in the class Child #1 (C1) attended. During the interview, Staff #2 (S2) admittedly said that S2 tells children to try and color the white spaces on the coloring material and tells children they can “do better next time”. Staff #3 (S3) confirmed that S3 has heard S2 utter words to children in the class that they can color the white spaces and do better next time. Staff #4 (S4) has not heard of any comments from S2. S4 covers S2’s shift and S4 does not work together with S2.

Interview with children: On 11/9/2023, the LPA interviewed five (5) children at the facility. 2 of 5 children confirmed that tickets are taken away from them when they do not do nice things.

Interview with Parents: On 10/20/2023, the LPAs called seven (7) parents. The LPA reached two (2) parents. The other five (5) parents did not respond to the Department’s request for an interview. The two parents interviewed didn’t disclosed any information that could support the allegations.

Records Review: On 10/9/2023, the LPA received several documents from the facility’s director regarding Behavior Chart per class. Based on the documents provided for C1’s class, “A child has the opportunity to receive a ticket every single day that they attend school or when he/she is kind…”, “If a child is struggling, or a behavior issue needs to be addressed, we will contact family”, no evidence that says a ticket will be taken away from a child which contradicts the statements from the staff.

Based on the LPA’s observations, record reviews and conducted interviews, the preponderance of evidence standard has been met, therefore the above allegation are found to be SUBSTANTIATED. A substantiated finding means that the complaint is substantiated, and the allegations are valid because the preponderance of the evidence standard has been met.

An exit interview was conducted with Stacey Ginesi. The Notice of Site Visit was posted during the visit. The director was informed that the Notice of Site Visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. The director was provided a copy of their appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. First-level appeals should be sent to the regional manager to the address listed above.
