On 12/8/2023 Licensing Program Analyst (LPA) A. Silva conducted an unannounced incident investigation inspection. This is a continuation of the investigation initiated on 9/20/2023. Upon arrival, the LPA met with director Cecelia McGregor and informed the director of the purpose of the visit. A review of the Facility Personnel Report Summary shows that all facility staff or individuals who require caregiver background checks have received a criminal record clearance and a child abuse index clearance or an exemption clearance. The census at the time of the visit was 102 children in 6 classrooms. The facility was operating within capacity and teacher-child ratios.

The Department received an incident report on 9/15/2023 alleging that a teacher punched a child in the face and hit the child several times while in the playground.

Interview with the complainant: On 9/18/2023, the LPA called the complainant requesting an interview. The complainant did not respond to the Department’s request for an interview. On 10/18/2023, the LPA called the complainant again requesting an interview, and provided a callback number. The complainant did not return the LPA’s request for an interview.

Interview with staff: On 9/20/2023, the LPA interviewed six staff at the facility. All staff consistently stated that the allegations did not happen or that they could not corroborate whether the allegations happened because they did not see any interactions between the child and the teacher who allegedly hit the child. No information that could corroborate the allegation was obtained during the staff interviews.

Interview with children: On 9/20/2023, the LPA interviewed six children at the facility. All six children were qualified. None of the children disclosed any information that could corroborate the allegations that a teacher punched and hit a child. No information about children’s personal rights violations was obtained during the interviews with children.

Interview with Parents: On 10/20/2023, the LPAs called seven parents. Two parents did not respond to the Department’s request for an interview. Five parents were interviewed. None of the five parents interviewed disclosed any information that could support the allegations.

Records Review: On 9/20/2023, the LPA reviewed several documents obtained from the facility’s director, including an internal investigation report and statements from eight staff members who were present on the day of the alleged incident. The records review did not yield any information that could corroborate that the allegations occurred.

Based on the interviews conducted and records review, the preponderance of evidence standard has not been met. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore the allegation is unsubstantiated.

The LPA reviewed the report with Director Cecelia McGregor and Executive Director Cheryll Ruszat. The Notice of Site Visit was posted during the visit. The director was informed that the Notice of Site Visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. The director was provided a copy of their appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. First-level appeals should be sent to the regional manager to the address listed above.
