32 | Interview with Parents: On 10/20/2023, the LPAs called seven parents. Two parents did not respond to the Department’s request for an interview. Five parents were interviewed. None of the five parents interviewed disclosed any information that could support the allegations.
Records Review: On 9/20/2023, the LPA reviewed several documents obtained from the facility’s director, including an internal investigation report and statements from eight staff members who were present on the day of the alleged incident. The records review did not yield any information that could corroborate that the allegations occurred.
Based on the interviews conducted and records review, the preponderance of evidence standard has not been met. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore the allegation is unsubstantiated.
The LPA reviewed the report with Director Cecelia McGregor and Executive Director Cheryll Ruszat. The Notice of Site Visit was posted during the visit. The director was informed that the Notice of Site Visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. The director was provided a copy of their appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. First-level appeals should be sent to the regional manager to the address listed above. |
