Licensing Program Analysts (LPA) Thompson conducted an unannounced complaint investigation. This is a continuation of the investigation initiated on 9/28/2022. Upon arrival LPA met with licensee Tena Kaye Madrid, to deliver complaint findings. Licensee guided LPA on a tour of the facility. LPA observed a total of 9 children with 2 staff.

A review of staff records on this date indicated that all facility staff or other individuals who required caregiver background checks have received criminal record and child abuse index clearances or exemptions.

The Department received a complaint on 09/27/22. Reporting Party (RP) alleged Licensee did not allow day care child's responsible party to pick up their child while in care and Licensee did not allow day care child's responsible party to observe their child while in care.

During the investigation LPA Thompson interviewed licensee, 2 staff members, and 3 parents. LPA conducted a facility inspection, reviewed children files, obtained the facility roster, obtained facility contract agreement, pictures of text messages, and pictures of the facility inside/outside

During the investigation, licensee was interviewed on 9/28/22. Licensee stated she ask for children to be dropped off by 9am because that is when the formal and structured program begins. Pick up is generally after 3:15 PM.

During the investigation, 2 staff members were interviewed on 9/28/22. Staff (S1) stated parents are allowed to drop off between 8am - 9am and pick up from 3:30 PM when they are done with snack until 5pm. S1 was asked if parents were allowed inside. S1 stated, When i started they were but since covid they stand by the door for pick up and drop off, if they discuss with licensee they are able to come inside.

S1 also stated she have witness parents picking up before 3:30 PM but they usually communicate with the licensee. Staff (S2) stated pick up is between 3:30 PM to 5 PM. When asked if parents are allowed inside, S2 stated Yes, if they ask licensee.

on 9/28/2022 LPA reviewed the enrollment contract. The contract states, there will be no drop-offs or pick ups allowed between 11:45 and 3:15. This does not eliminate your parental right to enter and inspect my facility at any time during normal operating hours. If you exercise this right, please be respectful of the children's routines and programmed activities.

On 10/7/22 LPA Thompson attempted to interview 7 parents, however only 3 parents were available for interviews. None of the parents disclosed any concern with the childcare facility or staff. All of the parents are happy with the childcare. Parent #3 stated we have had nothing but a positive experience. Very Positive with the staff. Our child enjoys it and is happy to be there. A fantastic experience for our family. All parents stated they have never been refused to observe their child while in care or been denied entry inside the day-care.

Based on LPA’s facility inspection, observations, interviews conducted with licensee, 2 staff, 3 parents and records reviewed it was determined there was insufficient evidence that did not allow day care child's responsible party to pick up their child while in care and licensee did not allow day care child's responsible party to observe their child while in care. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegation is Unsubstantiated.

Exit interview was conducted with licensee Tena Kaye Madrid. Notice of Site Visit was posted during the visit. Licensee was informed that the notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. Licensee was provided a copy of their appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. First level appeals should be sent to the regional manager to the address listed above.
