25 | The purpose of this visit was to conduct a Case Management Evaluation of the facility. LPA Han met with the director, Kristina Atler, and toured the facility inside and outside. Census was taken in individual classrooms. The overall census observed was 9 preschool staff and 80 preschool children. A review of staff criminal clearance records on this date indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.
On 12/11/2019, the Licensing Office received a self-report an incident that occurred on 12/10/2019. The facility filed Unusual Incident Report (UIR) stating that a child was discovered alone outside of the classroom. It was reported that the children were out on the play yard, teacher took children to classroom. The teacher did not realize a child was missing until a parent brought a child back to classroom. LPA Han interviewed staff who were present during the incident. LPA Han interviewed director. It was confirmed that a child was left out alone outside for 2-3 minutes without supervision. LPA Han discussed the supervision training with the director.
Based on LPAs interviews which were conducted and report review, the preponderance of evidence standard has been met, therefore it was found that there was a lack of supervision. California Code of Regulations, Title 22, Division, 101229(a)(1) being cited on the attached LIC 809D.
An exit interview was completed with Andrea Silva. The report was reviewed and discussed. Appeal Rights and deficiencies were discussed. The facility representative was provided a copy of their appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Licensing office within 15 business days. Any proposed changes to the physical plant, including telephone number, shall be immediately reported to the Department. The facility representative was informed that the “Notice of Site Visit” must be posted for 30 consecutive days. Failure to post will result in Civil Penalties of $100.00. The “Notice of Site Visit” must be posted on or adjacent to the door. |
