Licensing Program Analyst (LPA), Giselle Lucero conducted an onsite inspection for the purpose of an Annual Random. LPA and Assistant Director Kimberly Stevens toured the facility inside and outside. The floor and yard plan (LIC 999) were verified. Census was taken in each individual classroom. LPA observed a total of 33 preschool age children with 4 staff. Facility hours are Monday through Friday, 6:30 AM to 6 PM.

During the inspection it was determined the facility is operating within its licensed capacity. During record review, LPA observed Staff #2 (S2) was missing 3 units in a program/curriculum course and Staff #4 (S4) was missing 3 units in Child, Family, and Community course. S2 and S4 were observed to be not fully qualified teachers. S2 was observed caring for 9 children alone in a classroom and S4 was observed caring for 7 children alone in a classroom. Staff #3 (S3) did not have transcripts available for LPA to review. LPA is unable to determine if S3 is a fully qualified teacher. S3 was observed supervising 7 children alone in a classroom.

A review of the Facility Personnel Report Summary on this date indicates all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.

During the inspection of the indoor activity space, in a walkway storage closet that is located between two preschool classrooms, LPA observed a sliding latch that was not in good repair and was not in use to lock the closet door to make it inaccessible to children. LPA opened the closet door and observed a "TOP MOP" cleaning solution bottle on the floor and accessible to children. LPA also observed a classroom that was being used to have clutter of boxes, toys and other miscellaneous items stacked on top of each other in all areas of the classroom.

LPA interviewed staff #5 (S5) that was using the classroom, S5 stated they use the classroom occasionally for dance classes and the room is being used more frequently now due to the hot weather outside. There is filtered drinking water available indoors for children in care. Children also bring their water bottles from home. The children's bathrooms are clean and sanitary. Children nap on cots if they choose to sleep. LPA observed 2 cots with the mesh material torn leaving a hole in the cots on both ends. Bedding is stored individually and is taken home weekly to be washed by parents.

Food is prepared on site. Breakfast, lunch and snacks are provided. Food prep area observed to be clean and sanitary. Food is properly stored. Menus were posted where they could be reviewed by parents.


During record review, the facility was unable to show proof of documented fire/disaster drills. LPA is unable to determine if the facility has conducted an emergency drill within the past six months. The facility has a working carbon monoxide detector and fire alarms. Facility met all posting requirement. The California Child Passenger Safety Law was posted by the entrance of the facility.

The outdoor activity space was inspected for compliance. The playground was enclosed by a fence at least four feet in height. During inspection of the outdoor play yard, LPA observed a plastic construction play set that was not flat on the surface. Moments later a child who was playing on the construction play set, came to LPA and said "Uh oh" while pointing to the play set. LPA observed the play set had fallen over. LPA went to the play set and observed there were toys underneath the play set that were preventing the play set to be flat on the ground. LPA advised facility representative to ensure play yard is inspected to ensure all play equipment are flat on the surface to prevent them from falling on the children. LPA also observed a disinfectant spray bottle on the floor in the play yard and was accessible to children. LPA observed many outdoor play equipment with spider webs and spiders. LPA also observed 2 outdoor rugs that were dirty. LPA also observed a small green children’s trampoline with 2 holes on the outer part of the trampoline, one of the holes was big enough for LPA's hand to fit in the hole. LPA also observed a slide on a plastic play structure that was cracked, there was blue masking tape on the crack, however the cracks were still exposed.

The wood chips commercially produced for the purpose around the climbing equipment, structures, slides and other similar equipment appeared to be enough to absorbs falls. Drinking water in the outdoor activity space is by sports bottles with the child’s name on it. There are no bodies of water present at the facility.

Staff files were reviewed for staff present during the facility inspection of this date; 4 out of 5 staff files were reviewed. LPA was unable to review a file for S3 due to the facility not having a personnel record available. Health screening and immunizations as required were reviewed for 4 out of 5 staff. Beginning September 1, 2016, Health and Safety (H&S) 1597.622 states, a person shall not be employed or volunteer at a childcare center if he or she has not been immunized against influenza, pertussis, and measles. Proof of immunization against pertussis, measles for 4 staff were reviewed and within compliance. During record review, Staff #4 did not have a TB clearance on file.

Beginning March 31, 2018, H&S Code 1596.8662 requires all directors and employees to complete mandated reporting training, and to renew the training every two years. 3 out of 5 Staff had Mandated Reporter Training were completed and were not expired. LPA observed Staff #1 (S1) had an expired mandated reporter training certificate on file. Teacher present possesses current EMSA approved Pediatric CPR/First Aid certifications, which expires 02/17/2025.

Children's records were reviewed, and there was a separate, complete and current record for each child. A random sample of 5 children's files were reviewed for documentation of the child’s name, address, and telephone number of the child’s authorized representative and of relatives or others that can assume responsibility for the child if the authorized representative cannot be reached when necessary (LIC 700) and a medical assessment. During record review, LPA observed Child #3 did not have a completed physician report on file. LPA also observed child #2, #3, and #5 did not have a record of the measles vaccine. Record show children's immunization records were not updated and the last print date on all 3 immunization records were in the year 2022. Sign in/out procedure was reviewed for compliance. The person who signs the child in and out uses their full legal signature and records the time of the day.

Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Child Care Centers Sections 101173 and 101226. LPA Lucero informed facility representative that this report dated 06/25/2024 documents one Type A citation which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care.

Also, LPA Lucero informed facility representative to provide a copy of this licensing report dated 06/25/2024 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test. For child care center licenses issued after July 1, 2022, the licensee shall test their water for lead within 180 days of licensure pursuant to Written Directives section 101700 (PIN 21-21.1-CCP).

LPA verified that the lead testing was completed in accordance to the Written Directives outlined in PIN 21-21.1-CCP.

Exit interview conducted and report was reviewed with the facility representative Kimberly Stevens. A notice of site visit was given and must remain posted for 30 days.

Appeal Rights and deficiencies were discussed. The facility representative was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days.
