Licensing Program Analyst (LPA) Yesenia Villa conducted a case management visit on 10/24/19 for the purpose of investigating a self reported unusual incident reported to the department on 10/11/19. LPA met with Licensee Jeanette Lenzini who guided LPA on a tour of the facility. LPA observed 9 napping children upon arrival. Also present during today’s inspection was Rocio Lopez assistant. The facility was observed to be within ratio during today’s inspection. A review of staff records on this date indicated that all facility staff or other individuals who required caregiver background checks have received criminal record and child abuse index clearances or exemptions.
The allegation in this self reported incident alleged that a parent of a day care child alleged a child disclosed inappropriate sexual verbiage to the parent on or approximately 09/08/2019. The licensee self reported the incident to the department on 10/11/2019 via telephone and in writing. The licensee states she was not aware of any inappropriate, sexual language disclosure made by the child at any time prior.
The child’s last day of care as per file review was on 09/10/19. Licensee indicates she did not become aware of the allegation until she attempted to follow up on the child’s return date to the day care on 09/13/19. At this time the child’s mother disclosed to the licensee via text conversation that the child had disclosed some inappropriate, sexual language that was concerning to the parent. The child did not return to the day care after 09/10/19.
The licensee and the parent had conversations via text messages regarding the child being withdrawn from the day care without a 30 day notice and monies owed.
As per information obtained during the investigation the child had made a previous comment to the parent about seeing a “ghost in the licensee’s room during nap time, time and date unknown. Information obtained during interviews indicate that the child did wake up screaming from a nap about a month prior. The licensee states she comforted the child by soothing the child back to sleep and reaffirming that there were no ghosts.
