Licensing Program Analyst LPA Anna Chan conducted an onsite inspection for the purpose of an Annual Visit. Upon arrival of LPA around 2:20pm, nobody answered the doorbell. 5 minutes later, licensee arrived transporting 3 school-age children. Licensee transports children from school to the facility. Upon arrival, assistant Brandon Martinez also walked into the home. LPA and Licensee Miranda Bernstein toured the facility inside and outside and the floor and yard plan were verified. The downstairs consists of Living area, kitchen, and play area which are all accessible to children in care. Licensee stated that the upstairs is off limits to children in care. There are 3 school-age children present and there is 1 staff present at the time of visit. At 2:34pm, Licensee went to pick up other children and left children with the assistant (who has CPR exp. 11/2023). During the inspection, second batch of children (2 school-age) start arriving from school which is around 2:52pm . There is a fireplace that is screened with mesh panels. It was determined the facility is operating within its licensed capacity and within compliance of staffing ratios. Facility hours are 2:30p.m.- 6:00p.m., Monday through Friday.

There are 2 adults living in the home including the licensee. A review of the Facility Personnel Report Summary on this date indicates all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.

During the inspection of the indoor activity space, items which could pose a danger to children (detergents, cleaning compounds, and medications) were observed to be stored out of the reach of children. Poisons/Hazardous Items are not kept on the premises. Floors, equipment, and furniture were clean and were observed to be in good repair and free of sharp edges. The facility has conducted an emergency drill within the past six months. The facility has a working carbon monoxide detector and fire extinguisher in the home that meet statutory and State Fire Marshall standards

2 Staff files were reviewed for staff present during the facility inspection. Health screening and immunization as required were reviewed. Beginning September 1, 2016, Health and Safety (H&S) 1597.622 states, a person shall not be employed or volunteer at a family day care home if he or she has not been immunized against influenza, pertussis, and measles. Proof of immunization against pertussis, measles for the staff were reviewed and within compliance. Beginning March 31, 2018, H&S Code 1596.8662 requires all directors and employees to complete mandated reporting training, and to renew the training every two years. Upon record review, LPA did not find current mandated reporter training certificate for 2 staff present. At least one staff member present possesses current EMSA approved Pediatric CPR/First Aid certifications, which expires 11/2023.

The licensee does have a current roster of children in care. 3 Children’s records for children present during inspections were reviewed and is within compliance. The facility offers transportation for after school children.
LICENSEE WILL WAIT UNTIL FACILITY OPENS TO DETERMINE IMS NEEDS:
Incidental Medical Services (IMS) policy was discussed. For IMS information , see PIN 22-02-CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. The outdoor activity space was inspected for compliance. The outdoor play was enclosed by a wall ence at least four feet in height. The surface of the outdoor activity space was well maintained and free of hazards. There are no bodies of water present at the facility. The facility grounds were safe, sanitary and in good repair.

The licensee understands she must be present in the facility and must ensure children in care are always supervised. Children are not to be left alone in parked vehicles. When the licensee is temporarily absent from the facility, arrangements must be made for a qualified substitute adult to care and supervise children while absent. The substitute adult must have the required criminal record, child abuse index clearances, immunizations, Pediatric CPR/First Aid, and mandated reporter training. Licensee was advised to register through childcareadvocatesprogram@dss.ca.gov in order to receive quarterly updates. Licensee was advised of their responsibility to review the Provider Information Notices (PIN) found on the CCLD website. A copy of the California Department of Social Services Lead Information Brochure was explained and provided to the licensee.

In the areas that were evaluated, NO deficiencies were observed of the California Code of Regulations, Title 22, Division 12 at the time of the visit.

Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

Exit interview conducted and report was reviewed with the licensee Miranda Bernstein. A notice of site visit was posted and must remain posted for 30 days.

Appeal Rights were explained. The Licensee was provided a copy of appeal rights (LIC 9058 03/2022) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. First level appeals should be sent to the regional manager to the address listed above.
