The Department received a complaint on 1/21/22 alleging licensee is not allowing complaint party (CP) to enter and inspect unannounced. The CP stated, on 1/20/22 at 10:00am they had an appointment to review Child #1 (C1) artwork after an hour into the appointment CP was hurried out the facility. CP returned the following day and asked to enter and inspect the facility, CP was not allowed into the childcare unless CP could provide a copy of COVID-19 vaccines. During an interview on 1/27/22 CP did not have a concern of C1’s health and safety in the childcare.
During the investigation LPA Odom interviewed Complaining Party, Licensee, 2 staff, and 2 parents. LPA Odom reviewed the Children’s Roster, inspected facility COVID-19 protocols and took pictures. Children were not interviewed due to the allegation being Parent’s Rights.
During an interview on 01/28/22, licensee (S1) stated, on 1/20/22 at 10:00am CP had an appointment to review C1’s projects, CP was allowed to enter the off-limit area in the facility but not the childcare area because CP does not verify COVID-19 vaccines. S1 stated the appointment was scheduled for 15 minutes, however, S1 allowed CP to remain in the facility for an hour. After the hour S1 informed CP that S1 had another appointment to attend too. S1 stated, during the pandemic everyone schedules an appointment for any visits to avoid too many people entering and exposing the childcare facility. On 1/21/22, CP requested to enter the childcare area and Staff #2 (S2) informed CP they need to show proof of COVID-19 vaccines due to childcare facility COVID-19 protocols. S1 stated, they verbally informed parents, including CP, at the beginning of the pandemic that the pickup and drop off protocols had changed, and COVID-19 posters were posted outside at the front gate for parents to see the protocols during pick up and drop off.
During the investigation 2 staff members were interviewed on 01/28/22, Staff #2 (S2) stated, on 1/21/22 CP requested to enter the facility, but S2 did not allow CP to enter the facility due to COVID-19 protocols that has been implemented for all parents since the pandemic began. S2 stated CP has been allowed to enter the childcare facility before C1 was enrolled in the childcare, again in August 2021 when there were no children in the childcare, and the last time on 1/20/22 to review C1’s projects. Staff #3 (S3) stated before the pandemic parents were allowed to enter the childcare facility through the childcare playground, but when the pandemic started the children are dropped off at the gate of the facility where the COVID-19 posters are located.
