25 | Licensing Program Analyst (LPA) Cindy Nguyen conducted a Case Management inspection. LPA met with the director, Derek Weinmann. At 1:00pm, census was taken as follow: 12 school age children with 1 staff member. A review of staff criminal records indicates all facility staff or individuals who require caregiver background checks have received a criminal record clearance or exemption and a child abuse index clearance.
On 02/03/2023 LPA was informed by a staff, that facility staff did not provide chairs for children, forcing them to eat snacks on their knees at the table on 2/01/2023.
LPA interviewed 12 staff, including the director, all staff denied allegation. Staff #10 (S10) stated that there was an incident, upon S10 returning from break, all the chairs in the school age program were pushed in the cornered. S10 stated that the children were not allowed to use them since they didn’t clean up after an activity. The children eat their snacks standing or sitting on the floor. Director stated, she was told by S11 that the school age children were not listening and the children were told they can’t use the chairs. Director stated all she was informed that the children had snack outside at the picnic table except for one child who came late, was eating snack inside the classroom standing without a chair. S11 stated the children weren’t following the directions, chairs were all over the classroom and it was a tripping hazard, S11 told the children they lost their chance of using the chairs for the moment as they were outside.
Based on the information gathered from LPA’s interviews with staff of not providing chairs for children and forcing them to eat snacks on knees at the table is Substantiated. California Code of Regulations, Title 22, California Code of Regulations, Title 22 101223(a)(2) Personal Rights is being cited on the attached LIC809D.
Exit interview was conducted with Director, Derek Weinmann. Notice of Site Visit was posted during the visit. Director was informed that the notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. Director was provided a copy of their appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. First level appeals should be sent to the regional manager to the address listed above.
