Licensing Program Analyst (LPA) Dean Valencia conducted an unannounced complaint inspection on today's date, 8/3/22. LPA met with directors Noreen Begole and Tricia Dobler, who guided LPA on a tour of the facility and census of children was taken. 18 preschool children and 6 staff were present during the inspection. During the course of the investigation, LPA interviewed three staff, took census, and conducted a physical plant inspection/walk through. From staff interviews LPA was able to corroborate that on 7/28/22 at approximately 330pm a child, child #1 (see Confidential Names List LIC811), had been left unsupervised by staff. Child #1 left the facility and was in the parking lot of the facility, when an adult #1 arrived and obtained child #1, then notifying the facility that child was unsupervised in the parking lot. It was determined that the incident occurred during a rush of pick up, and the child unknowingly left out the open front gate into the parking lot, under the guise of another parent and their child. It is approximated that the child #1 was unsupervised for two minutes. Based on these interviews the facility has been determined to be in violation of Title 22 Regulations 101229(a)(1), and an A violation is cited on the attached LIC9099D. (continued on LIC9099C)

From the information gathered by LPA at the time of this inspection, the allegation of Staff left day care child unattended has been substantiated. Based on this gathered information, the preponderance of evidence standard has been met, and therefore the above allegation has been found to be substantiated.

Due to the Type A violations cited today, the facility shall post, and provide copies, of the report to parents/guardians of the children in care at the facility by the next business day, and shall provide to the parents/guardians of children newly enrolled at the facility during the next 12 months. The facility is to keep Acknowledgement Receipt (LIC 9224) signed by parents in each child’s file. In addition, the licensee shall immediately post upon receipt the Proof of Correction for 30 consecutive days.

Appeal Rights were explained and the facility was provided a copy of appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. First level appeals should be sent to the regional manager to the address listed above. A Notice of Site Visit form was given to licensee and must remain posted for 30 days. Exit interview conducted and report was reviewed with the facility representative.

In response to the incident, the facility immediately changed the sign in and out procedure to prevent from a similar incident occurring again. The sign in/out procedure has been moved from outdoor just by the front parking lot, to inside at the front desk. Staff now supervise the child being picked up and leaving with parent(s). The director will

determined that a child #1 was left by staff unsupervised in the facility parking lot, for approximately 2 minutes. This poses an immediate threat to the child/children's health, safety, and personal rights.

submit via email a detailed plan for how the facility has corrected this violation. In addition, during today's inspection LPA gathered an email sent to all parents in response to this incident.
