Tele-Inspection COVID-19 State of Emergency

Licensing Program Analyst (LPA) Torrence conducted an unannounced tele-complaint inspection on 11/18/2020 to follow-up on the tele-complaint investigation that was conducted on 08/10/2020. LPA met with Deborah Warkentien, owner, who guided analyst on a virtual tour of the facility. There were 31 children present and four staff supervising.

During today’s investigation the facility was operating within its licensed capacity and within compliance of staffing ratios. A review of staff records on this date indicated that all facility staff or other individuals who required caregiver background checks have received criminal record and child abuse index clearances or exemptions.

Allegation: child received a sunburn.
Reporting Party (RP) reported child receiving sunburns. RP stated sunscreen was provided to day care to apply on child when going outside and it was not put on child. During the course of the investigation, LPA interviewed owner, two staff members, and four parents.
Owner stated sunscreen was applied to child, by staff #1 and #2, according to mom’s direction, then they began applying twice a day, when mom stated child received another sunburn. Owner stated child was asked, in front of mom, if teacher put sunscreen on, and child answered “yes”. Both interviewed staff stated they applied sunscreen on child each time child went outside. Owner and staff denied observing any sunburns on child and reported child was happy and never complained.

Allegation: parents did not receive Parents’ Right form.
Reporting Party (RP) reported director did not provide parent with parents’ right form. RP reported the only paperwork she was given was the application.
Owner stated she provided enrollment packet including Parent's Right form to all parents as they enroll their children into her program.

There was no disclosure made from any of the parents interviewed. All four parents interviewed reported they received the Parents Rights form. Parent #2 and #4 required the staff to apply sunscreen on their children and had no issues with staff not applying it. Four parents interviewed had no issues or concerns with the facility.

Based on the information gathered from LPAs' interviews and document reviewed, there is insufficient evidence to corroborate the allegations. Although the allegations may have happened or is valid; there is not a preponderance of evidence to provide the alleged violations did or did not occur; therefore, the allegations are unsubstantiated.

Exit interview was conducted. The report was reviewed and discussed. Appeal Rights was explained. A copy of the report along with Appeal Rights (LIC 9058 12/15) will be emailed to licensee with a Read Receipt to acknowledge report was received. If Read Receipt is not functional, licensee will respond to email stating “I have read and received the report, I acknowledge receipt.” LIC 9099 will also be mailed if those options are not available. The Notice of Site Visit was not posted due to tele-investigation COVID-19 State of Emergency.
