On 09/23/2022 Licensing Program Analysts (LPAs), Stella Gutierrez and Romelia Castanon made an unannounced visit to the facility for the purpose to deliver findings of complaint that was received at the Orange County Regional Child Care Program Office. LPA was met by director who explained the reason for today’s visit.

A complaint was received on 07/05/2022 alleging staff did not change infant #1 diaper as often as needed. The reporting party stated that when Infant child was picked up from the facility, the infant had a full diaper of urine. The reporting party also stated that the alleged incident occurred the week of June 06, 2022 but did not provide an exact date. LPA made several attempts to contact Reporting Party on dates 07/05/2022-08/11/2022 and left messages for complaint to return call, LPA did not receive a return call, LPA was not able to interview the reporting party.

On 07/12/2022 LPA, Stella Gutierrez made an unannounced inspection to the facility regarding the allegation of Personal Rights. LPA Interviewed the director, Staff #1, Staff #2. During the interviews conducted, the director stated that the facility staff are to not wake the infants up to change the diaper if needed. Staff #1 and Staff #2, infant teachers assigned to classroom #4, stated that the infant diapers are to be changed every 2 hours, the infant staff stated that they also check the infant’s diapers when they are asleep and change them if needed.

On 07/12/2022 LPA obtained a copy of the infant children’s roster and a copy of the diaper changing logs for the week of June 06, 2022. Records obtained reveal that on June 09, 2022 the infant #1 in infant classroom #4 was not provided a diaper change for 4.5 hours while in care.

LPA, Gutierrez conducted 5 parent interviews 08/12/2022 through 08/15/2022. There were no disclosures from the parents interviewed regarding the allegation mentioned.

Based on interview with director and records reviewed, the allegation referenced on this report is substantiated. A substantiated finding means that the complaint is substantiated, and the allegation is valid because the preponderance of the evidence standard has been met. The following violation was revealed and is being cited a Type B in accordance with California Code of Regulations, Title 22, Division 12, Chapter 1, subchapter 2, Section 101428 (b) please refer to attached 9099 (D).



Exit interview conducted and report was reviewed with the director, Majgan Vasseghi . Appeal Rights and deficiencies were discussed. The facility representative was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days.

Director agrees to provide a training to the staff on Diaper changing and the regulation addressed. Director stated that she will provided a training agenda and role sheet of infant staff provided the training. Each staff will sign the role sheet. This training will be conducted and provided to LPA via email to stella.gutierrez@dss.ca.gov

On 06/09/2022 records reviewed revealed that the child in question was not provided a diaper change for a long period of time. Statement received by a staff stated that the children are not provided a diaper change when napping so the child is not interrupted. This poses a risk.
