Tele-Investigation due to Covid-19 State of Emergency
On 10/29/2020, Licensing Program Analyst (LPA) Tina Nguyen conducted a Tele- investigation via FaceTime Application to deliver the findings regarding the above complaint allegation. This complaint investigation had been started on 05/22/2020 by LPA Gesine Connolly and on 06/09/2020 by LPA Tina Nguyen. LPA Nguyen met with acting director Karen Barbosa remotely via FaceTime application. LPA notified the director that due to Covid-19 and Department of Public Health (DPH) guidelines of social distancing, a tele investigation is conducted. The Covid-19 Emergency Response questionnaires were asked.
Director indicated that there was a total of 5 children with 4 staff. A review of staff records on this date indicated that all facility staff or other individuals who required caregiver background checks have received criminal record and child abuse index clearances or exemptions.
On 05/15/2020, our office received a complaint and complainant reported that Staff made an inappropriate comment towards day-care child. On one occasion, a staff member told a child that “she (the child) was slow”.

LPA Nguyen conducted a telephone interview with three staff members and three children. No disclosures were made by staffs or children to LPA Nguyen. All interviewed staff members denied of making any inappropriate comment towards children in care. No staff member disclosed witnessing any staff making inappropriate comment towards children. All interviewed children stated they did not observe or witness any facility staff members making any inappropriate comment toward the children. All interviewed children disclosed they like going to this school.

LPA Nguyen contacted nine parents by phone and was able to interview three parents. All three interviewed parents stated they like the facility and all staff members are very nice. Interviewed parents also stated they did not have any concern or issue with the facility.

Based on the information gathered from LPAs' interviews, there is insufficient evidence to corroborate the allegation. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged staff made an inappropriate comment towards day-care child did or did not occur, therefore the allegation is UNSUBSTANTIATED.

Exit interview was conducted. The Notice of Site Visit was not posted due to tele-investigation Covide-19 State of Emergency. Appeal Rights was explained. A copy of appeal rights (LIC 9058 1/16) will be provided through email and their signatures on this form acknowledges receipt of these rights. First level appeal is to Regional Manager, address is above on the report.
