Licensing Program Analysts (LPA) Odom conducted an unannounced complaint investigation. This is a continuation of the investigation initiated on 10/03/2022. Upon arrival LPA met with Director, Susan Mendoza to deliver complaint findings. Director guided LPA on a tour of the facility. LPA took census, LPA observed a total of 6 infants with 2 staff in the infant room.
A review of staff records on this date indicated that all facility staff or other individuals who required caregiver background checks have received criminal record and child abuse index clearances or exemptions.

The Department received a complaint on 9/28/22 alleging facility staff are not qualified, and facility is not providing adequate supervision to day care children. Complaining party (CP) reported aides have been left alone with children in the classroom and on the playground, and director leaves the aides in charge when director is not in the facility.

During the investigation LPA Odom interviewed licensee, director, 3 staff members, conducted a facility inspection, and reviewed the children’s roster, personnel report, and staff personnel records. LPA did not interview children due to children’s age and being none verbal.

During the investigation, Director (S1) was interviewed on 10/03/22. S1 stated the maximum capacity for their infant license is 8 infants in one classroom. At this time there are 8 infants enrolled in the childcare but on average there are only 5-6 infants with 2 fully qualified teacher and an aide will provide additional assistance throughout the day. S1 stated they have never left an aide alone with the infants, they are very consciousness about making sure they are always in ratio. S1 stated if they need to step out for lunch or run an errand, they will designate Staff #5 (S5) who is a fully qualified teacher in charge of the childcare center or another fully qualified teacher from the preschool license. S1 stated if they plan to be off for a few days then the licensee will cover for the director.

During the investigation, Licensee (S2) was interviewed on 10/03/22. S2 stated due to low enrollment numbers in the childcare center they are currently over staffed in the infant and preschool center. S2 disclosed they never leave an aide alone with children, even though their aides have 6 ECE units and currently enrolled in college working in completing the rest of their ECE units, they don’t consider them teachers until they complete their 12 ECE units. S2 stated if S1 is off for the day or a few days they will come to the childcare center and cover, or they will send another fully qualified teacher from the other childcare center to cover for S1.

During the investigation, 3 staff members were interviewed on 10/03/22. All the staff confirmed that S1 is at the childcare center full-time. All the staff disclosed the only times S1 is not at the childcare center is during lunch break or to run an errand like laundry or pick up something from the other childcare center located less then 10 miles away. S5 stated during the time S1 is not at the childcare center they will assist until S1 returns. Staff #3 (S3) stated they will assist with the front desk when S1 is on their break, but they have never been left in charge of director duties. All the staff disclosed that the aides are never left alone with the children inside or outside. Staff #4 (S4) stated they assist in the infant center as a floater aide and there’s always a teacher in the classroom, the only time they have been left alone is during nap time.

LPA Odom reviewed staff’s personnel records to verify each staff member had qualified ECE units and experience according to regulations. All staff qualifications were in compliance.

Based on LPA’s facility inspection, observations, interviews conducted with licensee, director, 3 staff, and records reviewed it was determined there was insufficient evidence that facility staff are not qualified, and facility is not providing supervision to day care children. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are Unsubstantiated.

Exit interview was conducted with Director Susana Mendoza. Notice of Site Visit was posted during the visit. Director was informed that the notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. Director was provided a copy of their appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. First level appeals should be sent to the regional manager to the address listed above.
