Licensing Program Analyst (LPA) Patricia Duron conducted an unannounced complaint visit to deliver the complaint findings. LPA met with Director Kelsey Stevens. Census was taken. The overall census observed 1 staff and 5 school age children. A review of staff criminal clearance records on this date indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.

On 1/27/23 a complaint was filed with the Licensing office stating staff are not following appropriate infection control practice. RP stated multiple children in the building with Covid symptoms, none of them sent home or recommended to test. Children exposed to Covid were still allowed to mix in other classrooms. More than one staff out with Covid, nobody has reported exposure to parents.

During the course of investigation, LPA interviewed 3 staff members, 3 parents, and reviewed records.

During the initial inspection dated 2/2/2023 LPA Duron reviewed documents provided by Director informing enrolled families and staff of the positive cases at the facility. The documents states the actions the facility was following to disinfect and sanitize environment. The document states the facility will conduct wellness health checks at arrival and encourage families to monitor any symptoms their child may have, and to inform facility. Director stated if the children or staff tested positive, the children and staff would be quarantined for 5 to 7 days, and return with negative test and symptom free for 24 hours.

During the interview with 3 staff, all staff stated Director informs classrooms and families and monitor symptoms, 5 day mask wearing, staff and children who test positive quarantine for 5 days, and return with negative result. Sanitize facility and all the toys and cots. Inform families on Kindercare app, email, and in person when they pick up their child.

LPA interviewed 3 school age children. The 3 school age children stated teachers tell mom and dad. Teachers wear masks and some friends. We need to stay home until we are better and when our friends are better they come back to school.

LPA Duron interviewed three parents. All interviewed parents stated they did not have any concern with facility.

Based on LPA’s interviews and records review, there is insufficient information to corroborate the allegation of Staff are not following appropriate infection control practice. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur; therefore, the allegation is unsubstantiated.

Exit interview was conducted. The report was reviewed and discussed. The Notice of Site Visit was posted. Appeal Rights was explained. A copy of appeal rights (LIC 9058 1/16) was provided and their signatures on this form acknowledges receipt of these rights. First level appeal is to Regional Manager, address is above on the report.
All appeals must be in writing and received by the Licensing office within 15 business days.

The facility representative was informed that the “Notice of Site Visit” must be posted for 30 consecutive days. Failure to post will result in Civil Penalties of $100.00. The “Notice of Site Visit” must be posted on or adjacent to the door.
