A complaint inspection was conducted on this date, 2/23/22 by Licensing Program Analyst (LPA) Dean Valencia. LPA met with Site Supervisor Juan Dominguez to discuss the above allegations. During the inspection, a physical plant inspection/walk-through was conducted, census was taken, and 5 children were interviewed, At the time of the physical plant inspection/walk-through, 15 children were in care being supervised by 3 staff. This is a continuation inspection initiated on 2/1/22. During the course of the investigation, LPA conducted 2 seperate physical plant inspections, interviewed 6 staff, several parents, and 5 children. During LPA's observations of the classrooms, LPA observed preschool staff supervise the children at all times, and remain within complaince of 1 teacher to 12 children ratio. Staff were interviewed by LPA on 2/1/22 and 2/23/22, and during the interviews staff exhibited knowledge of supervision and ratio regulations and stated they are always to be within complaince of the Title 22 Regulations. Staff also stated that neither they nor any of their fellow coworkers have ever left a child/ren unsupervised, or in a setting to which a child was injured due to a lack of supervision. Staff also stated that the facility is always within 1 teacher to 12 children ratio and usually has 2 to 3 teachers with 16 to 20 children. (continued on LIC9099C)

Parents were interviewed on 2/22/22, and had generally positive feedback regarding the facility, and had no issues related to this reported allegation. Children were interviewed during the inspection on 2/23/22 and interviews did not provide any preponderance of evidence to support the allegations. From these interviews with staff, parents, and children; observations of the classrooms, and review of facility documentation related to the allegations, there was insufficient information to create a preponderance of evidence to support these allegations, in any way.

Based on all this information LPA gathered, the preponderance of evidence standard for these allegations was not met, therefore the above allegations are found to be unsubstantiated. From all of the available information obtained by LPA during the course of the investigation, that there is insufficient evidence indicating that a child was injured in care (due to a lack of supervision), and the classroom is out of ratio (1 teacher supervising more than 12 children at one time). Based on all of the information LPA gathered, LPA was not able to determine that these allegations were false or untrue. Therefore LPA cannot make the determination that these allegations are unfounded; and the most accurate findings would remain at unsubstantiated.

Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur; therefore, the allegations are unsubstantiated. Exit interview was conducted, and report was reviewed and discussed. Notice of Site Visit was posted during the visit. The facility representative was informed that the Notice of Site Visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100 per day. The facility was provided a copy of their appeal rights (LIC 9058 12/15) and their signature on this form acknowledges receipt of these rights.
