Licensing Program Analysts (LPA's) Thompson and Lucero conducted an unannounced complaint investigation. This is a continuation of the investigation initiated on 11/07/2022. Upon arrival LPA met with Director Stephanie Strand to deliver complaint findings. Director guided LPA on a tour of the facility. LPA observed a total of 50 children with 7 staff.

A review of the Facility Personnel Report Summary on this date indicates all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.

On 11/07/22 the Orange County Child Care Office received a complaint alleging Facility staff caused injury to daycare child and Facility staff pinched daycare child.

During the investigation, LPA reached out to Irvine Police Department on 11/08/2022 to obtain the case report. Irvine Police Department sent LPA the case report on 11/20/2022 and received by LPA on 11/21/2022. LPA conducted staff interviews on 11/30/2022.

The case report states “when STRAND interviewed S2, S2 admitting to seeing S1 pinch C1 on her cheek. Not only did she see her pinch her cheek on 11/02/2022, but she could recall at least two other times in the past that S1 had done this to C1.”

The case report also reads “when officer questioned STRAND about the specifics of what S2 told her, she told the officer S2 stated she had witnessed abuse from S1 in the form of pinching: she described the pinching as using her fingers to squeeze the child’s flesh between her two fingers, hard enough that C1 would cry.”

According to the case report “S2 had witnessed multiple occurrences of physical abuse from S1 onto the child and did not report this, ever, according to STRAND.”

After STRAND was informed about the information of S1 and the unacceptable behavior in the workplace, she met with S1 and sent S1 home for the day on 11/03/2022.

On 11/04/2022 Director STRAND contacted Department of Social Services, Community Care Licensing Division and informed Licensing S1 was still unable to return to the center and is in the process of being terminated.

On 11/30/2022 Director informed LPA, S1 was no longer employed at the center as of 11/8/2022.

Based on the case report received from Irvine Police Department, photos of C1 injuries, and interviewing staff, the preponderance of evidence standard has been met, therefore the above allegations are found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division & Chapter 1, 101223 (a)(3) Personal Rights is being cited on the attached LIC9099D.

LPA (Thompson) informed Director Stephanie Strand that this report dated 11/30/2022 document(s) one Type A citation(s) which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care.

Also, LPA Thompson informed the Director Stephanie Strand to provide a copy of this licensing report dated 11/30/2022 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

Exit interview conducted and report was reviewed with the Director Stephanie Strand. A notice of site visit was given and must remain posted for 30 days.



Appeal Rights and deficiencies were discussed. The facility representative was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days.

The director stated, S1 was terminated on 11/08/2022 from the chiildcare center.

The Director agreed to provide personal rights training all staff. Director will submit an email with information and list of staff who attended the training by POC due date December 14, 2022.

Based on case report received from Irvine Police Department, Photos obtained showing injuries to C1, interviews with staff who witnessed Staff 1 (S1) pinch C1 causing injury to C1 face. This is an immediate risk to the personal rights to the children in care.
