Licensing Program Analysts (LPA) Nunez and LPM Ho conducted an on-site inspection for the purpose of a Case Management Incident Inspection on 07/07/2023. LPA Nunez met with Assistant Director Nancy Echeverra. There was a total of 64 preschool children and 6 staff at the time of visit.

A review of staff criminal clearance records on this date indicated that all facility staff or other individuals who required caregiver background checks have received criminal record and child abuse index clearances or exemptions.

Today's Case Management inspection is being conducted in response to a self-reported incident, reported to the OC CCL office on 06/29/23.



During the inspection, Staff# 2 (S2) who directly is involved in the incident stated that when the Discovery P1 classroom (2 years old classroom) was outside in the playground S2 called the children to line up to transition to go inside the classroom. When S2 was counting the children, S2 noticed Child #1(C1) was missing. When S2 turned around and looked through the Discovery P1 classroom window S2 saw C1 was inside the classroom. C1 ran back outside where the teacher was located. S2 believes that C1 possibly ran past her and inside the classroom while getting the children to line up. S2 stated C1 was in the classroom alone for approximately 1 minute. S2 stated that when the classroom is outside C1 has attempted to run inside the classroom at least 4 times before but S2 was able to prevent C1 from entering the classroom alone. S2 also disclosed to the Director about C1 attempted to enter the classroom each time the incident happened.

No children were interviewed due to the children being non-verbal.

Per Assistant Director, a new teacher will start July 10, 2023 in the Discovery P1 classroom helping S2. Assistant Director will email LPA by July 10, 2023 confirming that the new teacher has started working in classroom Discovery P1 classroom.

This requirement is not met as evidence by: Based on LPA and LPM interviews with S1 and S2, it was determined C1 was left in the classroom alone for approximately 1 minute. This poses an immediate safety risk to the children in care.

After interviewing staff, it was determined C1 was left alone in the classroom for approximately 1 minute without supervision. The following violation is being cited in accordance with California Code of Regulations, Title 22, Division 12, 101229(a)(1) Responsibility for Providing Care and Supervision is being cited on the attached LIC 809D.

This is a Type 'A' violation the Director shall post and provide copies of the report to parents/guardians of the children in care at the facility by the next business day and shall provide to the parents/guardians of children newly enrolled at the facility during the next 12 months. In addition, the licensee shall immediately post upon receipt the Proof of Correction for 30 consecutive days. The director is to keep Acknowledgement Receipt (LIC9224) signed by parents in each child’s file.

An exit interview was completed. The report was reviewed and discussed. Appeal Rights were discussed. The assistant director was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the licensing office within 15 business days. The facility representative was informed that the 'Notice of Site Visit' must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100.00. The 'Notice of Site Visit' must be posted on or adjacent to the door. Failure to post Type A Reports for 30 days will result in a civil penalty of $100.00.
