Licensing Program Analyst (LPA) Barajas, conducted an unannounced complaint inspection as a continuation of complaint allegation and deliver findings. LPA met with Director Delmy Ortiz, who guided LPA on tour of the facility. There were 8 school age children present with 1 staff, in green classroom. A review of staff records on this date indicated that all facility staff or other individuals who required caregiver background checks have received criminal record and child abuse index clearances or exemptions.

During the investigation LPA Barajas interviewed New Director, 2 staff, 3 of 8 parents, and no children interviewed due to COVID 19. LPA Barajas also reviewed staff and children records, requested a children’s roster LIC 9040, Personnel Report LIC 500, requested parent handbooks, and conducted day-care facility inspections via facetime.

Complainant Party (C/P), reported to licensing Department: Facility does not ensure that each child has a lunch. C/P stated child does not get served lunch. C/P stated facility has a policy that no outside food can be brought in. The Child is a picky eater therefore does not eat. C/P stated child is asked to sit in couch while other children eat, and staff does not provide any alternative food for lunch. C/P stated facility provides snack twice a day, but child does not like the snacks. Child attends day care from 8a.m. to 5p.m. and sometimes does not eat at all while in care.

During the investigation new Director disclosed if children don’t like facility food, staff inform parents and staff try to encourage children to eat, if they don’t want to eat then they offer water. Director disclosed children are not allowed to bring lunch box from home due to COVID. Director stated before COVID children could bring lunch from home. Director disclosed facility is part of lunch program, parents fill out paperwork at time of register and program does not want facility to have children bring food from home. Director stated children are provided with lunch and snacks. Director stated children are offered alternatives if they don’t like the lunch such as fruit and veggies. Director stated facility updated parent handbook when facility reopened after first COVID closure. Director stated if children do not want to eat, they do a quiet activity on their own. Director stated parents are aware of changes and facility does have several children who are picky eaters. New Director stated is not aware if prior Director informed Licensing Department of Changes in Parent Handbook during COVID 19.

LPA Barajas conducted interviews with 3 staff on 02/23/2021. Two staff disclosed children are not allowed to bring lunch from home since COVID 19 started. Both staff disclosed parents are required to sign up child for lunch program at time of register. Staff disclosed they try to encourage children to eat and parents of picky eaters are aware children don’t like facility food. Both staff disclosed Child#1 was a picky eater and would bring lunch and snacks from home and would eat them but due to COVID child stopped as it was no longer allowed. Staff disclosed child#1 was very shy and don’t recall Prior Director trying to meet child’s needs.

During the investigation LPA interviewed 3 of 8 parents. A parent disclosed own child is very picky with food and would pack child’s lunch but was told could not do it after COVID started. Parent disclosed before COVID could pack lunch.

Parent disclosed when child was registered, had to sign a lunch form, from what parent understood it was funding for lunches. Parent disclosed had to sign up child even if child didn’t eat at day care. Two other parents disclosed children are not allowed to take box lunch. Four parents disclosed facility provides food and its part of day care schedule and package registered at sign up. A parent disclosed there are days child will eat and other days does not, child is a picky eater. Parents disclosed all changes occurred during COVID 19 and are required to sign up for Lunch Program.

Based on LPA Barajas interviews with New Director, C/P, 3 Staff,3 of 8 Parents, records reviewed, COVID 19 supplemental parent handbook, the allegation: the facility does not ensure that each has a lunch. This requirement was not met as evidenced by LPA interviews with 3 parents and 3 staff who disclosed children are no longer allowed to bring lunch box from home due to COVID 19 and children food needs, and arrangements are not available for daily food intake as part of requirements. Therefore, the preponderance of evidence standard has been met, and the allegation is found to be SUBSTANTIATED. Facility is being cited for Food Services 101227(3)(3) and Reporting Requirements 101212(e )(4) California Code of Regulations , (Title 22, Division & Chapter) is being cited on the attached LIC 9099D.

101227(3)(3)Food Services:(3) (3)Where meal service within a center is elective, arrangements shall be made to ensure availability of a daily food intake meeting the requirements of (a)(1) above for all children who elect meal service in their admission agreement.
101212 (e )(4)Reporting Requirements: (e)The items below shall be reported to the Department within 10 working days following their occurrence: (4) Any changes in the plan of operation that affect services to children.

This report cites a Type A violation and shall be provided to parents/guardians of children currently in enrolled and to parents/guardians of children newly enrolled at the facility during the next 12 months. Parents/guardians must sign Form LIC9224 to be kept in each child's file.

Exit interview was conducted with Director Delmy Ortiz via Facetime. Appeal Rights was explained. A copy of appeal rights (LIC 9058 1/16) will be provided through email and their signatures on this form acknowledges receipt of these rights. (The "Read Receipt" or licensee's email is in lieu of a signature). First level appeal is to Regional Manager, address is above on the report.

Director will sumbmit a letter in writing by email due by 02/25/2021 stating will be contacting the dept of Public Health and CDC and lunch program to inquire about lunch box from home and staff will make sure childrens needs are being met by either providing childen food alternantives that meet their needs.

This is a risk to the health and safety of children in care.

Based on interviews conducted facility failed to report changes to licensing department in regards to Covid 19 Supplemental Parent handbook which affects services to children in regards to food being provided by facility. Handbook was provided at time of interview. This is a potential safety risk to the children in care.
