On 6/10/2024 Licensing Program Analyst (LPA) A. Silva conducted an unannounced complaint investigation inspection. This is a continuation of the investigation initiated on 4/17/2024. Upon arrival, the LPA met with Yadhira Ramirez de Hernandez and informed Yadhira of the purpose of the visit. A review of the Facility Personnel Report Summary shows all facility staff or individuals who require caregiver background have received criminal record and child abuse index clearance. The census at the time of the visit was 13 children, including 4 infants.

The Department received a complaint on 4/12/2024 alleging that staff fed daycare children expired food, one staff cared for 12 children alone, staff yells at daycare children, staff force-feeds children, a child’s finger was injured on a door, and a staff lifted a child’s skirt.

The Reporting Party (PR) did not provide any contact information. An interview could not be conducted with the RP.

On 4/15/2024 and 4/16/24 The LPA requested records from the local law enforcement. A report documents a welfare check was conducted by a uniformed officer on 4/11/24. The responding officer did not find any evidence to support the allegations.

On 4/17/2024, the LPA interviewed three staff at the facility. All three staff denied the allegations.

Allegation: Staff feed daycare children expired food. S2 denied that they feed expired food to the children. S3 corroborated that children are fed only fresh food. On 4/17/2024, upon arrival the LPA observed S2 preparing children’s food with fresh ingredients. The LPA inspected the refrigerator. The food was properly stored. Fruits and vegetables were stored in containers and looked fresh. The milk and yogurts’ expiration dates were not due for more than 30 days from the day of the visit.

Allegation: Staff cares for 12 children alone. Staff #2 (S2) denied that S3 cares for children alone. S2 stated he/she took two weeks off work to help in the daycare while the licensee returned from out of the country. S3 said, “My ratio is six children when I’m alone” and added that when more children are in care, the licensee or another assistant is always present. The LPA observed S3 caring for 10 children while S2 prepared food in the kitchen.

Allegation: Staff yells at the children. S2 and S3 both denied that they yelled at the children.

Allegation: Staff force-feed children. S2 said they don’t force-feed children and added that leftover food is discarded. S3 also stated that they don’t force-feed children and said, “when children don’t want to eat all their food, we throw away the leftovers.”

Allegation: A child’s finger was injured on a door. S2 did not have information about a child’s finger injury and did not confirm or deny the allegation. S3 stated that no child has been injured during the time she has worked at the daycare. S3 said she started working at the daycare in June 2023. During the initial visit, none of the children present had a finger injury.

Allegation: Staff lifted a child’s skirt. S2 denied that a staff lifted a child’s skirt. S4 denied that a staff lifted a child’s skirt. During a phone call on the day of the initial visit, the licensee expressed her discontent with this specific allegation and denied the allegation.

On 4/17/2024, the LPA attempted to interview three children at the facility. Two children qualified for the interview. None of the children interviewed disclosed any information about the allegations. The rest of the children were not interviewed because they were not vocal due to their young age or did not qualify.

On 5/16/2024, the LPAs called six parents. Two parents were interviewed. The parents interviewed did not express any concerns about the daycare. The rest of the parents could not be reached or did not respond to the Department’s request for comment.

Based on the interviews conducted and records review, the preponderance of evidence standard has not been met. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are unsubstantiated.

An exit interview was conducted with Yadhira Ramirez Hernandez. The Notice of Site Visit was posted during the visit. The director was informed that the Notice of Site Visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. The director was provided a copy of their appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. First-level appeals should be sent to the regional manager to the address listed above.
