On 11/6/2024, Licensing Program Analyst (LPA) A. Silva conducted an unannounced Case Management – Legal/Noncompliance inspection assisted by Licensee Yadhira Ramirez de Hernandez. The licensee was informed of the visit’s purpose and a tour was completed. The census was 8 children, including 4 infants, at the time of the visit. The facility was operating within staff-to-child ratios and licensed capacity. An on-site Facility Personnel Report Summary review indicates all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.

During the visit the LPA toured the facility and took census. The LPA reminded the licensee of the conditions under which the facility can be operated based on the Noncompliance Conferenced (NCC) held on 2/7/2024. The following was discussed.

During the NCC the licensee stated she would keep closer supervision of the children in care by separating the children into groups (infants, toddlers, and school-age) and assigning one adult to supervise each group. During today’s visit, the LPA observed Staff #2 in the daycare area supervising all 8 children. Three of the infants were navigating the daycare area with older children during the visit, without separation. The licensee had been reminded of the daycare operation agreement established in the NCC during the previous visit on 8/23/24. The facility was not in compliance today. A violation of the Lega/Noncompliance agreement was observed during today’s visit. The licensee did not separate the children by age and assign an adult to each age group. The licensee stated that she disagreed with the deficiency because it is not possible for her to separate the children at all times. The licensee stated that all children are together during circle time, during free play time, and during outdoor playtime. The licensee stated the children are supervised at all times. The licensee separated the children at a later time; older children exited the daycare are to the outdoor play area and during lunch time. During nap time the infants were placed in cribs.

THE LICENSEE REFUSED TO SIGN. THE LICENSEE STATED SHE DISAGREES WITH THE VIOLATION OF PERSONAL RIGHTS.

The licensee separated the children during certain activities while the LPA was present. The stated that her plan was to ensure the children are not at risk. The licensee stated that she would request a clarification of the Legal/Noncompliance agreement.

The licensee was reminded that during the NCC, the licensee agreed to provide proof of current mandated reporter certification for personnel and volunteers working in the daycare. The licensee and S2 have valid Mandated Reporter Certification and current pediatric CPR certification. The licensee has proof of immunization in file for S2. The licensee was reminded to keep proof in file at all times children are in care.

The facility was not in compliance of the Legal/Noncompliance agreement. A citation was issued for CCR 103423(a)(2) Personal Rights.

Appeal Rights were discussed. The licensee was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. A notice of site visit was provided and must remain posted for 30 days. Exit interview conducted and report reviewed with Yadhira Ramirez de Hernandez.
