During the investigation, LPA interviewed, Reporting Party (RP), Licensee, 1 Staff, three parents, and 3 children. LPA reviewed children’s and staff’s records, Personnel Report (LIC 500), requested copy of children’s roster (LIC 9040).

An allegation: Child gets hit on the hands when child does something wrong
Complainant Party (C/P) stated a child disclosed to C/P not wanting to go back to day care because child gets hit on the hands when child does something wrong. C/P stated not sure if child gets hit anywhere else in the body. C/P stated has noticed from past incidents child has minor injuries. C/P stated asked licensee what had happened with injury and Licensee stated child was injured during play time.

During interview conducted with Licensee on 03/16/2021 via facetime, Licensee stated she works with assistant staff#2 and children are in living room or outside in backyard. Licensee stated does not care for many children. Licensee stated maintains supervision by walking around. Licensee is aware of personal rights and usually redirects children. Licensee stated if an incident occurs at facility, she informs parents immediately, daily at pick up time. Licensee stated discipline policy used at day care is normally to redirect children, separates children and offers different toys if a toy is the issue and distracts children by playing with them. Licensee disclosed has never hit children nor her staff. Licensee disclosed would never hit a child and would not allow staff or anyone to hit a child. Licensee stated has children, grandchildren and would never hit them.

During the investigation, LPA interviewed 1 staff separately. Staff disclosed discipline policy used at day care is to see eye to eye with child, redirect, move child aside so child can have a couple of seconds to themselves. If child is upset Staff brings child next to them and lets them calm down. Staff disclosed do not have assigned time out area, sometimes staff just grab a chair and sit child to calm down for a few minutes. Staff disclosed has never done anything to Child#1, sat child down a few times for time out. Staff disclosed has never hit children, however, has held child’s hand and walked child to time out area. Staff disclosed has never grabbed or hit a child in rough manner.

During interviews conducted 2 of 3 parents via phone. A parent interviewed stated Licensee and staff are good and notify immediately if an incident occurs via phone, text or at pick up time. Two Parents disclosed Licensee reports injury and incident immediately. A parent disclosed Licensee is very open regarding communication and child likes facility. Two parents disclosed have no concerns or issues with facility.

LPA interviewed 3 of 8 children, as the other children are too young to be interviewed and did not qualify to be interviewed. A child disclosed was hit by staff#2, 13 times. Child disclosed was hit in the armpit. Child was asked by whom, child just disclosed “I don’t know”. Child was asked to place 13 bear chips in table out of 25. Child skipped numbers and placed 19 bear chips. Other two children did not disclose being hit at day care. A child disclosed a staff calms child down by talking to them nicely. Two of the children interviewed, made no disclosures.

Based on the information provided to LPA by C/P, Licensee, 1 Staff ,3 parents and 3 of 8 children that LPA was able to interview, there was insufficient evidence to determine allegation: Child gets hit on the hands when child does something wrong while in care is unsubstantiated. Based on interviews with staff who denied hitting child or children and child#1 not being able to provide further details regarding being hit and no other children disclosing being hit at day care by Staff. Although the personal rights allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is UNSUBSTANTIATED.

Exit interview was conducted with Licensee Ernestina Saavedra via Tele-Inspection. Report was read to Licensee in Spanish. A copy of the report along with Appeal Rights will be emailed to Licensee with a Read Receipt to acknowledge report was received. If Read Receipt is not functional, Licensee will respond to email stating “I have read and received the report, I acknowledge receipt.” LIC 9099 will also be mailed if those options are not available.
End of Report.
