Licensing Program Manager (LPM) Lopez and Licensing Program Analyst (LPA) Connolly conducted an inspection to provide complaint findings. At the time of the LPM and LPA arrival Assistant Ariadna Jimenez was present with a total of three children in care, all of whom preschool age. The licensee Ascencion Hernandez-Arevalo who arrived within ten minutes of the LPM and LPA accompanied the LPM on a tour of the home.

A review of staff records on this date indicated that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances.

The two allegations, children in care were inappropriately touched and children were hit resulting in injury, received in the licensing office 11/14/19 were addressed in Spanish with the licensee. These allegations investigated by the Department’s Investigation Branch (IB) was also addressed. The licensee was informed that during the investigation the IB investigator, Thomas Smith, conducted staff and parent and children

interviews and reviewed medical and police records.

During today’s complaint inspection which was conducted in Spanish by LPM Lopez the licensee, Ascencion Hernandez-Arevalo, was interviewed. LPM Lopez notes the licensee said she had been unaware that three children in care had alleged inappropriate touching or being hit while in care. Licensee denied the actions described by the children occurred in the day care.

The IB investigator report notes CAST interviews were held with the three children involved in the allegations and through these interviews it could not be established if any assault happened in the day care. Two additional day care children interviewed by Anaheim PD denied observing incidences in the day care where children were inappropriately touched or hit by any staff member. Another day care child, qualified to be interviewed by the IB investigator, denied being hit or seeing anyone being hit while in care. There was no legal pursuit as a result of the police investigation.

It is further noted in the IB report that the day care assistant who was interviewed by the IB investigator denied observing children in care being hit or touched in an inappropriate manner. The co-licensee when interviewed by Anaheim PD and the IB investigator denied hitting or inappropriate touching children in care. The co-licensee when interviewed by the IB investigator added he has been running a day care for ten years.
The IB investigator notes when reviewing medical reports 'no signs of injury are noted'. Pictures provided to the IB investigator were determined unremarkable for abuse. Parent interviewed said there have been no problems expressed by their child in care.

During the exit interview when the report was reviewed and discussed the licensee was informed by LPM Lopez that the IB investigator has noted that based on the information obtained during the investigation there was no corroborating evidence or witnesses to support that children in care were touched inappropriately or were hit resulting in injury.

Additionally, the interviews conducted today did not change what was found by the IB investigator. Therefore, although the allegations of daycare children being inappropriately touched while in care and staff hitting children resulting in bruising may have happened or are valid there is not a preponderance of evidence to prove the violations did or did not occur, therefore, the allegations are unsubstantiated.

No deficiencies cited.

Appeal Rights were discussed. The facility representative was provided a copy of their appeal rights (LIC 9058 12/15) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the licensing office within 15 business days.


Notice of Site Visit was posted.


The facility representative was informed that the 'Notice of Site Visit' must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100.00. The 'Notice of Site Visit' must be posted on or adjacent to the door. Failure to post type A reports for 30 days will result in a civil penalty of $100.00.
