Licensing Program Analyst (LPA) Dean Valencia conducted an unannounced complaint inspection on today's date, 7/29/2021. LPA met with the licensee, Rana Suleiman who guided LPA on a tour of the facility. Census of children in care was taken, 6 children and one assistant were present. During today’s inspection the facility was operating within its licensed capacity and within compliance of ratios. During the course of the investigation, LPA interviewed licensee and 2 assistants assistants, several parents, four children, made two separate physical inspections, and reviewed documentation related to the complaint. During an interview on 6/30/21, the licensee and adult resident/assistant (adult #1, see LIC811 Confidential Names List) stated that neither them nor any staff have violated the personal rights of children nor Title 22 Regulation. Both they and the staff at this facility are aware of personal rights regulation, and the facility operates within compliance of these regulations. LPA interviewed licensee and 2 assistants on 6/30/21, and 7/29/21. The assistants interviewed stated that the facility and the licensee is always within compliance of children's personal rights, and that everyone is aware of these personal rights regulations. They stated they all always treat the children with respect, allow them entrance to the home and always meet their needs. (continued on LIC9099C)

LPA interviewed several parents on 7/7/21, and 7/26/21. Parents stated that they were not witness to any issues or violations at the facility nor had any concerns at the facility and had generally positive responses for their experience with the facility. LPA also interviewed four children on 7/29/21. From the information obtained from the children interviews, it was not determined that the facility had violated the personal rights of children, related to the allegations. From these interviews, there was insufficient information to create a preponderance of evidence to support either of these allegations.

Based on all this information the preponderance of evidence standard for this allegation was not met, therefore the above allegations are found to be unsubstantiated. From all of the available information obtained by LPA during the course of the investigation, that there is insufficient evidence indicating that daycare children cry excessively while in care, children do not have access to the home, children are left outside during excessive heat, licensee threatens children when they cry, and licensee yells at children. Based on all of the information LPA was able to obtain, LPA was not able to determine that these allegations were false or untrue. Therefore, LPA cannot make the determination that these allegations are unfounded and the most accurate finding would remain at unsubstantiated.

Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur; therefore, the allegations are unsubstantiated. Exit interview was conducted, and report was reviewed and discussed. Notice of Site Visit was posted during the visit. The facility representative was informed that the Notice of Site Visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100 per day. The facility was provided a copy of their appeal rights (LIC 9058 12/15) and their signature on this form acknowledges receipt of these rights.
