On 01/21/21 Orange County Child Care Office received a complaint allegation stating children are able to exit the home unsupervised.
LPA conducted interviews on 01/29/21, 03/15/21, and 03/16/21 with 3 staff, 8 parents, and 2 children. LPA also reviewed staff and children’s rosters. Interviews with 3 of 3 staff revealed children only play inside the home and the backyard. All 3 stated the front door is always closed and parents have to ring the doorbell to pick up or drop off their child. Interviews with 1 of 2 children revealed children only play inside and the backyard. Interviews with 8 of 8 parents revealed they had to ring the doorbell when they drop off and pick up their child. 1 of 8 parents stated sometimes the door is already open when another parent is already there and they come in behind them.
During the course of the investigation, LPA was able to obtain images which show the front door of the facility open and a preschool aged child wandering out of the facility unsupervised and unaccompanied until the child was escorted back and the licensee notified. This constitutes an absence of supervision on the licensee’s end. LPA reminded licensee children need to be supervised 100 percent of the time and the children in their care are their responsibility until the children are picked up by their parents. It was discovered during the investigation this incident was not reported by the licensee to the Department. LPA reminded licensee to report any unusual incidents that threaten the health and safety of children in care.
Based on interviews and records reviewed, the facility was not in compliance and violations of the California Code of Regulations, Title 22, Division 12 were observed, discussed and cited at the time of the visit. The following violations of the California Code of Regulations, Title 22; Division 12, were observed and cited today: Reporting Requirements 102416.2(b)(2)
102416.2 Reporting Requirements:
(b) The licensee shall report to the Department any of the events as specified in Health and Safety Code Sections 1597.467(b)(1)(A) through (b)(1)(C) that occur during the operation of the family child care home.
(2) Any child absence means any instance where a child in care is missing. For example, any child in care who wanders away from the Family Child Care Home, is lost during an outing, or does not return from school, shall be reported even if the child is later found safe.
