On 09/08/2021, Licensing Program Analysts (LPAs) Tina Nguyen conducted a in person inspection to deliver the findings regarding the above complaint allegations. LPA Nguyen met with licensee Alia Ibrahim. The Covid-19 Emergency Response questionnaires were asked. A toured the facility was conducted, and a census was taken. Observed at the time of the visit was a total of 2 infants, 4 preschool children, 1 school age child, licensee and 2 assistants are providing care. A review of staff criminal clearance records on this date indicated that all facility staff or other individuals who required caregiver background checks have received criminal record and child abuse index clearances or exemptions.
On 07/29/21, the office received a complaint alleging Licensee serves spoiled food to daycare children. Licensee does not properly store food. Daycare children are being physically abused while in care. Licensee uses inappropriate forms of discipline. Reporting Party (RP) disclosed the following: licensee served strawberries with mold to children. Licensee would leave food on top of the counters without covering the food to prevent the flies from landing on the food. Licensee put misbehaved children in a room, and they would come back crying. A staff member caused a mark on a daycare child.

During the investigation, LPA interviewed four staff members, five parents, four children, and reviewed facility roster, and staff files.
On 8/3/2021, Licensing Program Manager (LPM) Ho and LPA Nguyen conducted an initial 10-day inspection and toured the entire facility including the kitchen and garage where licensee stored all the food to serve the daycare children. All the food was observed to be within the shelf life and unexpired. LPA observed 1% milk and 100% juice stored in the refrigerator, fresh fruit, cereal, and bread. Licensee stated she received free lunch and snacks for the children from the YMCA daily which includes all food groups: Fruits, Vegetables, Grains, Protein Foods, and Dairy. Licensee stated all food are free and plentiful; thus, she has no reason to serve spoiled or mold food to the children. The food was observed to be plentiful to serve more than 40 individuals at a time. Both kitchen and garage were observed to be cleaned. No flies observed anywhere in the entire facility.

During the staff interview, all interviewed staff members stated the food is good at the facility. Licensee and staff members always check the expiration date before giving the food to children. All interviewed staff did not see licensee served children with mold fruits. Interviewed staff shared that there were no flies in the daycare classroom and children will not be served the food that flies landed on. Interview staff indicated if children did not listen, the staff members will talk to children, give them few choices. At no time, interviewed staff witnessed any child was put in the room if the children did not listen. Interviewed staff indicated that they did see children with unexplained mark on their body.

All interviewed children stated licensee gave them good food. They’re never served any fruits with mold at the facility. Interviewed children stated that there were no flies in the daycare. If someone did not listen, the teachers will tell them to sit down and talk to them. Interviewed children did not see any friends was put in the room if they misbehaved. Interviewed children did not witness any friends received any injury at the facility. All interviewed children stated the teachers are nice at the facility.

LPA Nguyen interviewed five parents at the facility. All interviewed parents stated they like the facility and all staff members are very nice. Interviewed parents stated they like the food licensee serves which is very healthy to the children. One parent disclosed his children preferred going to this daycare instead of taking a vacation. All Interviewed parents stated they did not have any concern or issue with the facility.

Based on the information gathered from LPAs' interviews and observation, there is insufficient evidence to corroborate the allegation. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged licensee serves spoiled food to daycare children, licensee does not properly store food, daycare children are being physically abused while in care, licensee uses inappropriate forms of discipline did or did not occur, therefore the allegations are UNSUBSTANTIATED.

Exit interview was conducted. The Notice of Site Visit was posted. Appeal Rights was explained. A copy of appeal rights (LIC 9058 1/16) will be provided through email and their signatures on this form acknowledges receipt of these rights. First level appeal is to Regional Manager, address is above on the report.
