Tele-Inspection

Licensing Program Analyst (LPA) Carmen Odom conducted an unannounced complaint Tele-Inspection to investigate the above allegations and deliver findings. The licensee was informed that due to COVID-19 and social distancing guidelines, the visit would be conducted via Facetime. This is a continuation of the investigation initiated on 06/11/2020.

Upon arrival LPA Odom met with Licensee, Svetlana Chernobrovina who guided LPA on tour of the facility. A census was taken and there were 10 children present at the home with the licensee and 2 assistants. No children were under the age of 2 years. During today’s inspection the facility was operating within its licensed capacity and within compliance of staffing ratios.

A review of staff records on this date indicated that all facility staff or other individuals who required caregiver background checks have received criminal record and child abuse index clearances or exemptions.

The Department received a complaint on 06/08/2020 alleging lack of supervision of the childcare children, and that the licensee does not provide a safe environment. The allegation indicates there was childcare children are allowed to play in the alley behind the complex, and the licensee allows the children to run out and play unsupervised. It was also reported that when the children play in the back alley, they are very noisy.

During the investigation LPA Odom interviewed complaining party, 2 staff members, 2 adults, and 7 parents. LPA reviewed the Children’s Roster, printed pictures of the location, including the front and back of the outside location in question via Google Maps.

During an interview on 06/17/2020, the licensee stated she received a recorded message from a neighbor, name not disclosed, stating “the kids were too loud”. Licensee, stated, another time while walking with the children a neighbor told her they work from home and “the children are loud”. Licensee stated children play in the back yard and front yard for about 20-30 minutes and take walks around 11:00am 20-30 minutes.

LPA Odom interviewed two staff. Both staff stated the licensee had told them that neighbors have complained that the children are too loud. The staff stated the children usually play outside at 11:00am, in the backyard and in the alley. Staff stated licensee supervises the younger children in the backyard, while staff #2 supervises the older children in the alley. The older children play in the alley with bikes, and balls. Staff #1 stated she watches 5-6 children outside, and the other children stay inside with licensee. Both staff stated cars do not drive up and down the alley, and the cars park and drive on the street in front of the homes.

Two adults were interviewed on 10/07/2020. Adult #2 stated that on 06/24/2020 a noise complaint was received from homeowners, and a letter was sent to the owner and tenant addressing the noise violation

Adult #2 stated a response was never received, however, in the last two months no children have been observed playing outside. We inspect the properties every two months, by walking around and through the properties. Adult #2 stated before the month of August about 5 times children were observed playing outside in the backyard or the alley, and there was usually at least 1 adult watching the children. The adult #2 stated that even though the back is called an “alley”, it is not designated for vehicles to drive up or down the alley, because there is a tree, and bench in the middle of the alley where people can sit or walk around. The garages of the homes are located on the front, and we have not had any issues or accidents in the alley. LPA Odom printed picture of the back alley from Google maps on 08/05/2020.

Seven parents were interviewed on 10/13/20, 10/14/20 and 10/16/20. All parents interviewed confirmed the children play outside in the backyard or alley. All parents interviewed stated the children are always supervised by either the licensee or assistants. The parents expressed the children really like the childcare.

Based on the information obtained during interviews with the licensee, staff, adults and parents interviewed, it was determined there was insufficient evidence there was lack of supervision or an unsafe environment. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations of lack of supervision and unsafe environment did or did not occur, therefore the allegations are Unsubstantiated.

An exit interview was conducted with the Licensee via tele-inspection on this date. Appeal Rights were reviewed and explained. A copy of this report and Appeal Rights (LIC 9058 1/16) where emailed to the licensee. First level appeals should be sent to the Regional Manager to the address listed above. The licensee will email a received acknowledgement as her signature for this report due to the tele-inspection delivery by typing, “I have read and received the Investigation Report, I acknowledge receipt” in the subject line of the return email.
