Tele-Investigation COVID-19 State of Emergency

Licensing Program Analyst (LPA) Corral conducted a complaint investigation with the facility in response to a complaint received on 02/16/2021 regarding children having access to explicit adult material while in care. The incident was also self-reported to the Licensing Office by Licensee Martha Jauregui on 02/02/2021. This is a continuation of the investigation initiated on 02/25/2021.

LPA Corral conducted a Tele-Inspection via FaceTime and spoke with Licensee Martha Jauregui, Licensee was informed that due to COVID-19 and Department of Public Health (DPH) guidelines of social distancing a tele-investigation would be conducted. The COVID-19 Emergency Response questionnaire was reviewed and answered by Licensee.

During the Tele-Inspection Licensee stated there were 4 school age children and 1 infant present in care while Licensee was providing care. A review of staff records on 04/15/2021 indicated that all facility staff or other individuals who required caregiver background checks have received criminal record and child abuse index clearances or exemptions. During the course of this investigation LPA Corral conducted interviews with Licensee Martha Jauregui, Complainant, and three Children’s Parents.

On 02/25/2021 LPA Corral conducted an interview with Licensee Martha Jauregui, during the interview licensee stated the children were having their lunch break in the backyard. Licensee stated she walked around the yard and checked on each group of children and observed three children in the right corner of the yard being suspicious as they were operating an iPad. During the course of the investigation it was discovered the tablet being used was a School District tablet. Licensee stated the children complete Virtual Learning while they are in care. Licensee believed the School District tablets were censored and blocked from adult material. Licensee also stated she contacted the School District and they were unable to explain how the children had access to explicit adult content.

Licensee informed LPA Corral she was present in the yard and had visual supervision of all three children. Licensee stated after she discovered the children were watching adult content, she separated the children and contacted their parents. The interview with Child 1 (C1’s) parent confirmed the Licensee was in the yard when the children were observed watching inappropriate adult content. C1 informed parent Licensee was present in the backyard when incident occurred.

LPA Corral also interviewed Child 2 (C2’s) and Child 3 (C3’s) parent. Parent interviews revealed children were watching adult content on School issued devices. Both parents of C2 and C3 stated they have no issues or concerns with provider and are satisfied with their childcare. The photograph provided by Licensee demonstrates the distance between where the Licensee was standing and where the children were sitting. This photograph supports Licensee’s statement which shows Licensee did have visual supervision of the children while they were in care.

Based on the information gathered from the interviews conducted with the Licensee, the Complainant, the three Children’s Parents and photograph received there is insufficient evidence to corroborate that the children had access to explicit adult material while in care was due to lack of supervision. Although the children did have access to adult content while in care, there is not a preponderance of evidence to prove the alleged violation did or did not occur due to lack of supervision, therefore the allegation: regarding children having access to explicit adult material while in care is Unsubstantiated.

Exit interview was conducted with Licensee via Tele-Inspection. Report was read and reviewed with Licensee Martha Jauregui. Appeal Rights were also explained, Licensee was informed first level appeal is to Regional Manager, address is provided above on the report. A copy of the Investigation Report along with Appeal Rights will be email to Licensee with a Read Receipt to acknowledge report was received. Licensee was asked to respond to email stating “I have read and received the report, I acknowledge receipt.” This statement will be used in lieu of Signature. The Notice of Site Visit was not posted due to Tele-Investigation COVID-19 State of Emergency.
