Tele-Visit
Licensing Program Analyst’s (LPA’s) Barajas conducted a complaint investigation. This is a continuation of the investigation initiated on 05/06/2020, via facetime. LPA met with Licensee Michelle Simpson, who guided LPA on tour of the facility. Licensee had no children in care during today's visit. During today’s inspection the facility was operating within its licensed capacity and within compliance of staffing ratios. A review of staff records on this date indicated that all facility staff or other individuals who required caregiver background checks have received criminal record and child abuse index clearances or exemptions.

During the investigation, LPA interviewed Licensee, 5 of 6 Staff members on 04/01/20, 05/06/20, 05/26/20, and 07/27/20. No children were interviewed due to age and being nonverbal, and parents requesting not to have their child interviewed, reviewed sign in sign out sheets, reviewed personnel files, obtained copy of the Children’s Roster (LIC 9040) and LPA attempted to interview neighbors, was not successful.

LPA conducted two separate Tele inspections of facility via facetime. Based on records reviewed, the licensee was licensed on 06/18/19 and agreed that the covered outdoor play area that is an open space between the back door and leads to the detached garage. The two ends of the play area are open, one to the back yard and one to the other side of the house understood that the outdoor play area cannot be the main area for day-care.

The complainant alleged Children are left outside in the rain and cold weather all day, not allowed to be inside the home. Complainant stated worked for day care for two days, and both days it was cold and pouring rain, and children only allowed to go inside when they are taking a nap. Complainant disclosed she would change all children outside; it was too cold, and poop was dry.

During interviews conducted on 05/06/20, the Licensee stated the areas in her home that are part of her day care is her bedroom next to the hallway, the bathroom, all patio area outside, living room and kitchen. Licensee on 07/28/2020 disclosed to LPA via facetime that the majority of time children are out in back patio. Licensee indicated patio has a Television, tables, ceiling fan, and all toys and materials are available for children outdoors.

During the investigation LPA Barajas interviewed 5 of 6 staff members on 04/01/20, 05/06/20, 05/26/20, and 07/27/20 all disclosed day care is conducted outside in in patio back yard area and only go inside to nap or use bathroom. A staff disclosed since began working at day care children have never been inside home in living room, only outside. A different Staff disclosed children are always outside, only nap and use bathroom inside the home. Same Staff disclosed there is also a diaper changing station outside in patio as well as inside in day care room.

Throughout the course of the investigation LPA Barajas interviewed 3 of 6 parents who disclosed day care is conducted outside in big patio. A parent disclosed children hardly go inside home and are cared for in a Den. A parent also disclosed children need more of a learning area and an AC as sometimes it’s too hot during the summer. A parent disclosed day care is outdoors, kids are not inside the home, and drops off and picks up her children up late and they are outside with no sweaters. A parent disclosed children are changed outside, there is a mat outside, no pad to change children.

During tele inspection on 05/06/2020 and 07/27/2020, LPA was able to observe a covered outdoor play area (Patio) that is an open space between the back door and leads to the detached garage. The two ends of the play area are open, one to the back yard and one to the other side of the house. LPA was able to observe children outside in covered patio area watching TV or reading a book on a table. Patio area decorated as day care with toys, tables, carpet, and TV displayed against the wall.
No children were interviewed due to age and being nonverbal, and parents requesting not to have their child interviewed.

On 03/10/2020 LPA’s Odom and Han conducted a case management visit during nap time hours. Children were napping inside the home. LPA Odom disclosed when conducting facility inspection of home, LPA’s were not able to observe any day care toys, equipment or children belongings inside the home, however LPA’s were able to observe all day care toys, equipment and belongings outside in patio area.

Based on LPA Barajas tele inspection, observations, interviews with RP, Parents, and Staff which were conducted on 04/01/20, 05/06/20, 05/26/20 and 07/27/20, records reviewed, the licensee failed to care for children inside the home and provide the same home environment as provided in a traditional home setting as agreed at Prelicense visit on 06/18/2019 and instead is caring for children outdoors in patio area all day. Licensee reposed children in outdoor patio during day care hours, not providing comfortable
accommodations. Therefore, the preponderance of evidence standard has been met, therefore the above allegations are found to be SUBSTANTIATED. California Code of Regulations, Title 22, 102352(f)(1) Definitions, and 102423(a)(2) Personal Rights is being cited on the attached LIC 9099D.

102352(f)(1) – Definitions: The house next door to the family childcare provider or an unattached building or garage does not constitute “The caregiver’s own home.” Health and Safety Code Section 1597.40(a), which states public policy to provide a home environment in residential surroundings, states a family childcare home should provide the same home environment as provided in a traditional home setting. An unattached building or garage without toilets, kitchen, or bedrooms does not provide a traditional home setting. Since the language of the California Child Day Care Act is very clear, a waiver will not be approved which authorizes use of a facility other than “the provider’s own home” or a “traditional home setting.” However, unattached buildings and garages may be used as additional play space, etc. when free access to the house is allowed.

102423(a)(2) Personal Rights- (a) Each child receiving services from a family childcare home shall have certain rights that shall not be waived or abridged by the licensee regardless of consent or authorization from the child's authorized representative. These rights include, but are not limited to, the following: (2) To receive safe, healthful, and comfortable accommodations, furnishings, and equipment.

This report cites a Type A violation and shall be provided to parents/guardians of children currently in enrolled and to parents/guardians of children newly enrolled at the facility during the next 12 months. Parents/guardians must sign Form (LIC 9224) to be kept in each child's file.

Exit interview was conducted with Licensee Michelle Simpson via Tele-Inspection. Report was read to Licensee. A copy of the report along with Appeal Rights will be emailed to Licensee with a Read Receipt to acknowledge report was received. If Read Receipt is not functional, Licensee will respond to email stating “I have read and received the report, I acknowledge receipt.” LIC 9099 will also be mailed if those options are not available.

Licensing Program Analyst’s (LPA’s) Barajas conducted a complaint investigation. This is a continuation of the investigation initiated on 05/06/2020, via facetime. An allegation: Child wondered out of day care facility.
Reporting Party (R/P) stated Licensee had disclosed she had to let go of two assistants due to an incident that occurred while she was on vacation in Panama. R/P stated police came to Licensee’s home due to incident of child attempting to elope from the day care facility. R/P stated Licensee saw camera footage and saw police and chaos that went on at her house, while she was on vacation. R/P stated does not have knowledge of the two assistants who were terminated. R/P stated Anaheim Police Dept contacted Licensee about record of a child walking away from day care. R/P stated doesn’t have knowledge of missing child’s identity.

The Licensee was interviewed on 05/06/2020 via facetime. Licensee acknowledged she was out on vacation, Licensee had 4 assistants present at facility at the time of the incident. Licensee disclosed child was triggered by being forced to nap and ran out of the facility. Licensee suggested staff to contact child’s parent. Licensee disclosed the child’s parent called the police as the parent was driving from work and would not arrive immediately to pick up child. Licensee disclosed when the parent arrived, the police were already at the facility. Licensee stated when child ran out of the gate 3 staff followed child. Child was never out of visual observation or left alone.

During the investigation, LPA interviewed 4 of 6 staff via facetime. Staff disclosed child did not want to fall asleep. Staff disclosed the licensee was contacted via phone for the purpose of talking with the child and to encourage the child to fall asleep. Three staff disclosed child became upset and ran out of the facility, and one staff followed child. Three staff disclosed child ran to the front yard and sat in the driveway. Three staff disclosed child was never left alone. While the incident was occurring, a staff member was inside the home caring for the other children in care.

During the investigation, LPA conducted 4 of 6 parent interviews via telephone. Three parents disclosed are aware of an incident that occurred on Friday 03/05/2020 approximately 6p.m. A parent interviewed disclosed they heard a child ran out of backyard, and police showed up. A second Parent disclosed they heard of a child getting out of facility and was in the middle of street, a police report was taken, and that a neighbor called police. Same parent disclosed when arrived to pick up own child, police was already there. Another parent disclosed they heard a child got out of the facility. Other parents did not provide details.

Based on the information and interviews gathered by LPA Barajas, from Licensee, 6 staff and 6 parents, records reviewed and the inability to interview children as they did not qualify and or parent not allowing child to be interviewed, and neighbors not being available to interview there was insufficient evidence to determine if the allegation: Child wondered out of day care facility is substantiated. Based on 4 staff interviews child was never left alone, staff followed child who ran out the gate to front yard. Although the allegation: Child wondered out of day care facility may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is UNSUBSTANTIATED.

The complainant alleged Children are only fed rice for lunch and cucumbers for snack.
During interviews conducted on 05/06/20, the Licensee stated her day care provides breakfast, lunch and dinner. Licensee also admitted is part of Food Program. Licensee disclosed her menu can consist of corn, rice, meat with salsa, water, milk, snacks, fruit, crackers and cookies.

During the investigation LPA Barajas interviewed 5 of 6 staff members on 04/01/20, 05/06/20, 05/26/20 and 07/27/20. All 5 staff disclosed children’s lunch and snacks can consist of peanut butter sandwiches, fruit, pieces of oranges, rice, hot dogs, and corn, carrots, meat, chicken, beans apples. Staff disclosed didn’t see anything wrong with food. All 4 Staff also disclosed never witnessed licensee taking food away from children. 2 of 5 Staff disclosed aware facility is part of food program.

Throughout the course of the investigation LPA Barajas interviewed 3 of 6 parents. A parent disclosed child likes food and is fed mac and cheese, or pasta. A second parent disclosed children fed cereal, usually children eat hot dogs, nachos for lunch and hot pockets, chicken, rice and corn for dinner. A third Parent disclosed no issues with food.

No children were interviewed due to age and being nonverbal, and parents requesting not to have their child interviewed.

Based on LPA Barajas tele inspection, observations, RP, Parents and Staff interviews which were conducted on 04/01/20, 05/06/20, 05/26/20 and 07/27/20 and records reviewed, there is insufficient evidence to prove if the violation did or did not occur. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged Children are only fed rice for lunch and cucumbers for snack did or did not occur, therefore the allegation is UNSUBSTANTIATED.

The complainant alleged Children left in play pin for hours and crying.

During interviews conducted on 05/06/2020, the Licensee stated day care has play pens and children sleep inside play pens. Licensee also disclosed if children does not want to be inside play pen, staff pick up child.
During the investigation LPA Barajas interviewed 5 of 6 staff members on 04/01/20, 05/06/20, 05/26/20 and 07/27/20. All 5 staff disclosed home day care has play pens and children are not left inside them all day.

Throughout the course of the investigation LPA Barajas interviewed 3 of 6 parents. All 3 parents did not have concerns with children’s personal rights being violated.

No children were interviewed due to age and being nonverbal, and parents requesting not to have their child interviewed. LPA Barajas on 05/06/2020 did not observe via facetime any children inside play pens.
Based on LPA Barajas tele inspection, observations, RP, Parents and Staff interviews which were conducted on 04/01/20, 05/06/20, 05/26/20 and 07/27/20 and records reviewed, and no children being interviewed due to age and being nonverbal, there is insufficient evidence to prove if the violation did or did not occur. Exit interview was conducted with Licensee Michelle Simpson via Tele-Inspection. Report was read to Licensee. A copy of the report along with Appeal Rights will be emailed to Licensee with a Read Receipt to acknowledge report was received. If Read Receipt is not functional, Licensee will respond to email stating “I have read and received the report, I acknowledge receipt.” LIC 9099 will also be mailed if those options are not available.
