On 8/20/2024 at 1:10PM, an Annual Random inspection was conducted at the facility by Licensing Program Analysts (LPA)K. Navar. LPA observed licensee Valdovinos, Yeimi and Assistant Stephany Erazo caring for 4 infants and 5 preschool age children. Licensee was operating within the licensed capacity as specified on license.

A review of the Facility Personnel Report Summary on this date indicates all facility residents, staff, or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. Currently there are 1 adult and 2 children living in the home. Facility Day care hours are 7:30am-5:30pm, Monday through Friday.

During today’s inspection, LPA and licensee toured the inside and outside areas identified in the facility sketch as accessible to childcare children. Facility is a single-story home with 4 bedrooms and 2 bathrooms. Off limit areas are the 3 bedrooms,1 bathroom, and garage. Off limits areas are made inaccessible by means of door locks and baby gates. Day-care areas are the living room, kitchen, sun room, backyard. The home has age-appropriate toys for the ages served. During today’s inspection LPA’s observed dramatic play equipment, and manipulative toys.

Licensee stated they use the backyard for outdoor play that has a fenced pool. Fence is about 5ft in height and is constructed so that it does not obscure the pool from view. The sun room (day-care room) has access to the backyard through two sliding glass doors and two windows. Licensee was asked on 6/24/2021 to install an alarm on each window that has direct access to the pool. During inspection on this date, Licensee stated windows that have direct access to the pool do not have alarms but are locked at all times. LPA observed the windows to be locked on this date and two wooden boards that are about 4 ft in height from the floor that cover the bottom of the window with a dramatic play kitchen against the wall under the window.

Licensee stated there is an alarm on both sliding glass doors that have access to the fenced pool. Both sides of the house have a pool entry gate that swings away from the pool. During inspection of the gate that is located on the day-care side of the backyard. Licensee opened the gate of the pool and let go. Gate did not self-latch and licensee pushed the gate closed with her hand. Licensee stated that she has a key lock on the gate and keeps it locked. Gate did not self-latch as this poses as a health and safety risk to children in care.

LPA verified there is a working telephone service (cellular service), licensee was reminded that childcare phone needs to remain the in the childcare at all times.

There are working carbon monoxide, smoke detector, and fire extinguishers in the home that meet statutory and State Fire Marshall standards. Emergency drill last documented 5/13/2024. Detergents, cleaning compounds, medicines, and other items which could pose a danger if readily available to children were stored inaccessible to children. There were no poisons or other items observed which could pose a danger to children or if they were observed, they were locked or inaccessible. Licensee stated there are not firearms and/or other dangerous weapons in the facility and none were observed during today's inspections. There is a fireplace that is barricaded and inaccessible to children in care.

The licensee has a current roster of children in care. 5 Children’s records for children present during LPA’s inspection were reviewed for a copy of the emergency information card that contains all the information specified by regulation (LIC 700), Immunization records, Affidavit Regarding Liability Insurance (LIC282), Consent for Emergency Medical Treatment (LIC627), Notification of Parent’s Rights (LIC995A) and found to be in compliance. Licensee stated, there is 4 infants under 24 months enrolled in the childcare. LPA reviewed napping logs for 4 infants in care. LPA spoke with licensee regarding LIC 9227 Individual Infant Sleeping Plan 4 infants in care. Licensee stated they do not have record to review.

The licensee EMSA approved Pediatric CPR/First Aid certification expires 9/2024. Beginning September 1, 2016, Health and Safety (H&S) 1597.622 states, a person shall be immunized against influenza, pertussis, and measles. The licensee does have proof for self and assistant. Beginning March 31, 2018, H&S Code 1596.8662 requires all licensed providers and employees to complete mandated reporting training, and to renew the training every two years.

Incidental Medical Services (IMS) policy was discussed. Licensee stated she does not give medication to children in care. For IMS information see PIN 22-02- CCP. When any IMS is provided, an updated Plan of Operation that includes IMS must be submitted to the Department. The licensee understands they must be present in the facility and must ensure children in care are always supervised. Licensee was reminded that children are not to be left alone in parked vehicles. Licensee stated they do not transport children. When the licensee is temporarily absent from the facility, arrangements must be made for a qualified substitute adult to care and supervise children while absent. The substitute adult must have the required criminal record, child abuse index clearances, immunization's, Pediatric CPR/First Aid, and mandated reporter training. CCLD website www.cdss.ca.gov/inforesources/community-care-licensing was provided to licensee to access regulations, updates, and licensing forms.

Licensee was advised to register through childcareadvocatesprogram@dss.ca.gov in order to receive quarterly updates. Licensee was advised of their responsibility to review the Provider Information Notices (PIN) found on the CCLD website. A copy of the California Department of Social Services Lead Information Brochure was explained and provided to the licensee.

LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee [facility representative] of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain childcare by connecting them to childcare providers and Resource and Referral Agencies (R&Rs) throughout California.

Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

During the exit interview, the LICENSEE Villa De Valdovinos, Yeimi confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile on 8/20/2024

Based on LPAs observations, record review and interview the following violation was observed Licensee opened the gate of the pool and let go. Gate did not self-latch and licensee pushed the gate closed with her hand. Licensee stated that she has a key lock on the gate and keeps it locked. Gate did not self-latch as this poses as a health and safety risk to children in care. Type A citation is being cited in accordance with California Code of Regulations, Title 22, Division 12, Chapter 3, Section CCR102417(g)(5)(A). See the attached LIC 809D.



If the facility receives a Type A violation, the licensee shall post and provide copies of the report to parents/guardians of the children in care at the facility by the next business day and shall provide to the parents/guardians of children newly enrolled at the facility during the next 12 months. In addition, the licensee shall immediately post upon receipt the Proof of Correction for 30 consecutive days and provide a copy to current and enrolling parents. The licensee is to keep Acknowledgement Receipt (LIC 9224) signed by parents in each child’s file. Failure to post Type A reports for 30 days will result in a Civil Penalty of $100.00

Exit interview conducted and report was reviewed with the licensee Yeimi Villa De Valdovinos. A notice of site visit was given and must remain posted for 30 days.

Appeal Rights were explained. The Licensee was provided a copy of appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. First level appeals should be sent to the regional manager to the address listed above.
