Licensing Program Analyst (LPA) Carmen Odom conducted an unannounced complaint inspection to deliver the findings for the above allegation. This is a continuation of the investigation initiated on 02/02/22. At 1:45pm, LPA Odom met with Licensee, Ruby Urrea who guided LPA on tour of the facility. Census was taken and there were 3 infants, and 1 school age child playing in the childcare area with 1 assistant.
A review of staff records on this date indicated that all facility staff or other individuals who required caregiver background checks have received criminal record and child abuse index clearances or exemptions.

The Department received a complaint on 1/27/22 alleging licensee hit day care child. The complaint party (CP) stated, on 1/27/22 Child #1 (C1) told CP that Staff #1 (S1) hit C1 on their bottom earlier that day. CP checked to see if C1 had any marks, bruising or any type of injury but C1 did not have marks or bruising on their bottom.

During the investigation LPA Odom interviewed complaining party, Licensee, 1 staff, 3 parents, 4 children and reviewed the Children’s Roster.

During an interview on 02/02/22, S1 stated, they have never yelled or hit a child in care. S1 stated, they have placed their hands on C1 in a bear hug position to hold C1 back from hurting other children. S1 disclosed in the last 6 months C1 has become very aggressive with the other children by physically trying to hit the children with toys and playing very aggressive. S1 stated, they will remove or redirect C1 to avoid from hurting other children. S1 stated, they did inform the child’s parent (P1) of C1’s behavior in the childcare.

During an interview on 02/02/22, Staff #2 (S2) stated, they have never observed S1 hit any of the children in care. If a child is not listening or misbehaving, they will redirect the child by giving them a different toy or activity. S2 stated, S1 will focus on the child and give the child that is misbehaving additional attention while S2 supervises the rest of the children. S2 disclosed they have observed C1 throw and kick toys and attempt to hit the infants.

LPA Odom interviewed 4 children on 02/02/22. Three out of four children disclosed that the staff do not yell or hit the children in care. If a child is not listening or misbehaving the staff will give them time out by sitting in a chair in the kitchen or giving them quiet time in the living room. The children interviewed denied ever being hit by staff or witnessing any other child being hit. C1 disclosed to LPA that S1 hit their bottom because C1 was physically shaking the infant’s playpen.

LPA Odom attempted to interview 6 parents; however, 3 parents were available to be interviewed on 03/17/22 and 03/23/22. Two out of three parents stated, they do not have any concerns with the childcare, and they are satisfied with the childcare. P1 stated, they were not aware of the incident until CP informed P1. P1 discussed the incident with C1, C1 told P1 that S1 hit them on the leg. P1 discontinued care.

Based on LPA facility inspection, observations, interviews conducted with complaint party, licensee, 1 assistant, 4 children and 3 parents, and records reviewed it has been determined there was insufficient evidence that Licensee hit C1 on their bottom. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are Unsubstantiated.

Exit interview conducted and report was reviewed with the licensee Ruby Urrea in Spanish. A notice of site visit was given and must remain posted for 30 days.

Appeal Rights were explained. The Licensee was provided a copy of appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. First level appeals should be sent to the regional manager to the address listed above.
