INVESTIGATION FINDINGS:

A complaint inspection was conducted on this date, 2/10/22 by Licensing Program Analyst (LPA) Dean Valencia. LPA met with director Manil Gunasekara to discuss the above allegation. During the inspection, a physical plant inspection/walk-through was conducted, census was taken, and 4 children were interviewed, At the time of the physical plant inspection/walk-through, 55 children were in care being supervised by 7 staff.
This is a continuation inspection initiated on 12/10/21. During the course of the investigation into the above allegation, LPA conducted 2 seperate physical plant inspections, interviewed 7 staff, several parents, and 4 children. During LPA's observations of children in the classrooms, LPA was able to observe that staff exhibited appropriate and compliant interactions with the children. Staff were interviewed by LPA on 12/10/21, and during the interviews staff exhibited knowledge of personal rights regulations and stated they are always to be within complaince of the children's personal rights. Staff also stated that neither they nor any of their fellow coworkers have ever violated a child's personal rights. Parents were interviewed on 12/13/2021, and had generally positive feedback regarding the facility, and had no issues related to this reported allegation.

From these interviews with staff, parents, and children; observations of the classrooms, and review of facility documentation related to the allegation there was insufficient information to create a preponderance of evidence to support this allegation, in any way.

Based on all this information the preponderance of evidence standard for this allegation was not met, therefore the above allegation is found to be unsubstantiated. From all of the available information obtained by LPA during the course of the investigation, that there is insufficient evidence indicating that a staff spanked a child at any point while in care. Based on all of the information LPA was able to obtain, LPA was not able to determine that this allegation was false or untrue. Therefore LPA cannot make the determination that this allegation is unfounded; and the most accurate finding would remain at unsubstantiated.

Although the allegation may have happened or are valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur; therefore, the allegation is unsubstantiated. Exit interview was conducted, and report was reviewed and discussed. Notice of Site Visit was posted during the visit. The facility representative was informed that the Notice of Site Visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100 per day. The facility was provided a copy of their appeal rights (LIC 9058 12/15) and their signature on this form acknowledges receipt of these rights.
