Licensing Program Analyst (LPA), Romy Castanon conducted an onsite inspection for the purpose of a 3-Year Annual. LPA toured five individual classrooms and later met with Director Myriam Stephanie Rivero. There were 32 children and 7 staff members at the time of LPA’s visit. The floor and yard plan (LIC 999) were verified. Facility hours are Monday through Friday, 7:30 AM to 5:30 PM.

A review of the Facility Personnel Report Summary on this date indicates all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.

During the inspection of the indoor activity space, LPA did not observe any items which could pose a danger to children (poisons, detergents, cleaning compounds, medications or hazardous items). There is a filtered drinking water dispenser system in each classroom. Disposable cups are available indoors for children in care but they are also encouraged to bring their own water bottles/sippy cups. The children's bathrooms are clean and sanitary. Children nap on mats if they choose to sleep and bedding is stored individually. Families provide the linens and are taken home every week to be laundered. Facility does not provide snack or lunch for children. Families provide lunch and snack for children.

The facility has conducted an emergency drill within the past six months, last conducted on 01/17/2024. The facility has a working carbon monoxide detector and fire alarm. Facility met all posting requirements. The California Child Passenger Safety Law was posted by the entrance of the facility office.

The outdoor activity space was inspected for compliance. The playground was enclosed by a fence at least five feet in height. The surface of the outdoor activity space was well maintained. The sand commercially produced for the purpose around the climbing equipment, structures, slides and other similar equipment appeared to be enough to absorbs falls. The outdoor equipment and toys were free of sharp edges. Director was made aware of the rough finish on the wooden play structure and toy vehicle. There are no bodies of water present at the facility. The children water bottles are refilled using the filtered water dispenser before going outside. Staff are available to refill the bottles as needed.

Five staff files were reviewed. Health screening and immunizations as required were reviewed. Beginning September 1, 2016, Health and Safety (H&S) 1597.622 states, a person shall not be employed or volunteer at a childcare center if he or she has not been immunized against influenza, pertussis, and measles. Proof of immunization against pertussis, measles for five staff were reviewed and within compliance.

Beginning March 31, 2018, H&S Code 1596.8662 requires all directors and employees to complete mandated reporting training, and to renew the training every two years. 5 out of 5 staff members had current Mandated Reporter Training certificates that does not expire until 04/2025. At least one staff member present possesses current EMSA approved Pediatric CPR/First Aid certifications, which does not expire until 05/2025.

Sign in/out procedure was reviewed for compliance. The person signing the child in/out uses their full signature and records the time of day.

Director was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test.


For child care center licenses issued after July 1, 2022, the licensee shall test their water for lead within 180 days of licensure pursuant to Written Directives section 101700 (PIN 21-21.1-CCP).
LPA verified that the facility has not received a lead test in accordance to the Written Directives outlined in PIN 21-21.1-CCP.

LPA discussed the safe sleep regulations with Director and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed Director of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

This facility provides Incidental Medical Services – IMS. LPA reviewed storage of “medication and equipment/supplies, and reviewed children’s, personnel, and administrative records.

Director was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain childcare by connecting them to childcare providers and Resource and Referral Agencies (R&Rs) throughout California.

In the areas that were evaluated, the following deficiencies were observed of the California Code of Regulations, Title 22, Division 12 at the time of the visit; 101429 Responsibility for Providing Care and Supervision for Infants and Health & Safety Code 1597.16 Lead.

Exit interview conducted and report was reviewed with the Director Myriam Rivero.A notice of site visit was given and must remain posted for 30 days.
Appeal Rights and deficiencies were discussed. The facility representative was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days.
