32 | During the investigation LPA made several attempts to contact the Reporting party, but the information furbished remains invalid. LPA interviewed the Director, Assistant Director and five staff members on site on 01-31-20 and obtained additional supporting documents. LPA obtained AM/PM breaker schedule/ Employee training manual/ Facility roster/ Staff sign in sheets and children assignment sheet in each classroom.
During interviews conducted it was disclosed by all the five staff members that the facility has a designated staff person for both AM/PM shifts to covers the ten minute break in each of the eight classrooms, while lunch breaks are covered by co-teachers within the classrooms during nap time. LPA also received consistent statement from all the staff interviewed including the Administrative staff who stated, “At any given time the teacher has twelve or less in classroom in care while the other teacher shall assist the remaining children to use the restroom.” One staff also stated that Administrative staff is also available to provide additional support in the classroom when needed. Facility Director denied the allegation and indicated having sufficient staff in the facility and ratios are maintained in each classroom through the day, most of the classroom have less than ten children enrolled in the classroom.
On reviewing the classroom configuration, LPA noted Teacher– Child ratio is being maintained by the facility.
Based on the information gathered from LPA's observations, and the interviews conducted there is insufficient evidence to corroborate the allegation. Although the allegation may have happened or are valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation for Facility operating out of ratio is being unsubstantiated.
Exit interview was conducted and Director was provided with a copy of their Appeal rights (LIC 9058 01/16). Notice of Site Visit was posted during the visit. Facility representative was informed that the notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100.
