Tele-Investigation due to Covid-19 State of Emergency
On 03/25/2021, Licensing Program Analyst (LPA) Tina Nguyen conducted a Tele- investigation via FaceTime Application to deliver the findings regarding the above complaint allegation. This complaint investigation had been started on 09/04/2020 by LPA Tina Nguyen. LPA Nguyen met with director Melissa Dudley remotely via FaceTime application. LPA notified the director that due to Covid-19 and Department of Public Health (DPH) guidelines of social distancing, a tele investigation is conducted. The Covid-19 Emergency Response questionnaires were asked.
There was a total of 12 school age children with 2 staffs in once classroom per school director. A review of staff records on this date indicated that all facility staff or other individuals who required caregiver background checks have received criminal record and child abuse index clearances or exemptions.On 09/04/2020, our office received a complaint and reporting party (RP) reported there were two weeks a child did not come to the center; however, the facility staff had marked that the child had attended during this time. LPA talked to the complaint but the complaint did not remember when this occurred. (Continue on page 2)

LPA conducted a telephone interview with three staff members. No disclosures were made by staff members to LPA. All interviewed staff members denied of knowing facility marked attendance for child when they were not at the facility. Facility representative stated in the past, facility had a lot of issues with one of the parents who constantly forgot to check the child in and out in the facility digital sign in system. Sometimes the parent only checked the child in and forgot to check the child out or vice versa. Facility representative also stated they always make sure the parents review and sign the sign-in and out sheet at the end of each month before the facility sends it to Children’s Home Society to claim for the child’s tuition reimbursement.

LPA Nguyen contacted five parents by phone and was able to interview two parents. All two interviewed parents stated they like the facility and all staff members are very nice. Interviewed parents also stated they did not have any concern or issue with the facility; Interviewed parents did not experience facility marked attendance for child when they were not at the facility.

LPA reviewed the children’s sign-in & out sheets and it showed subject child was absent for about 6 days for the month of August and September 2020. RP did not remember which day the subject child was absent from the facility.

Based on the information gathered from LPAs' interviews and reviewing records, there is insufficient evidence to corroborate the allegation. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged Facility marked attendance for child when they were not at the facility did or did not occur, therefore the allegations is UNSUBSTANTIATED.

Exit interview was conducted. The Notice of Site Visit was not posted due to tele-investigation Covide-19 State of Emergency. Appeal Rights was explained. A copy of appeal rights (LIC 9058 1/16) will be provided through email and their signatures on this form acknowledges receipt of these rights. First level appeal is to Regional Manager, address is above on the report.
