On 08/03/22, Licensing Program Analyst (LPA) Tran conducted a subsequent investigation and deliver the findings regarding allegation that day care child is being bullied by other day care children. LPA Tran met with Director Perla Arrieta.

A tour around the facility was conducted, and a census was taken. Observed at the time of the visit was a total of 39 school age children and 5 staff members.

A review of the Facility Personnel Report Summary on 08/03/2022 indicates all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.

On 05/17/2022, the Regional Office received a complaint with allegation alleging day care child is being bullied by other day care children. The Reporting Party reported that subject child would not be allowed to play with other kids if subject child doesn't have money and that the children were putting mean letters in child's backpack.

During the course of investigation, LPA Tran interviewed 2 staff and 3 children on the initial 10-days investigation at the facility on 05/20/2022. On 08/03/2022, LPA Tran conducted a subsequent investigation and interviewed 4 staff and 4 children. LPA Tran also reviewed facility’s Family Handbook and facility's training documentation and action plan to address the concern of alledged bullying behaviors.

During interviews, LPA Tran interviewed 2 staff at the facility on 05/20/2022 and 4 staff on 08/03/2022. All 6 out of 6 interviewed staff denied that they had ever witnessed any child being bullied by others. All interviewed staff shared that they were trained to use immediate redirection to intervene and if any child continue to exhibit challenging behaviors, staff will communicate with team members and use myPath app to find approaches or strategies to help support positive behaviors as well as communicate with parents. All 7 interviewed children including the subject child, 3 children were interviewed on 05/20/2022 and 4 children were interviewed on 08/03/2022, denied that they have experienced any bullying behaviors toward themselves or witnessed any other child being bullied by others. 4 out of 6 interviewed children disclosed that they played a game with each others in which subject child pretended to be a child who got in trouble at school for having bad notes written on their paper, one child was playing the role of the parent and another child was playing the role of the teacher. 4 out of 6 interviewed children also shared that they made deals to win challenges when they played with each others and whoever wins will get the prize of an ice cream, which was why subject child mentioned about one dollar child needed due to losing in the challenge. 3 out of 6 interviewed children said teachers would not allowed them to have challenges that involved using money.

During record reviews, LPA Tran reviewed facility's Family Handbook as well as the myPath app, which was used by the staff to address and manage challenging behaviors including bullying, it showed that the facility use Positive Behavioral Support model to prevent and respond when any child exhibits challenging behaviors. These strategies can be used to help child acquire skill for self control, set limits and making appropriate choices. LPA Tran also review facility's documentation on steps taken to address the concerns of the alleged incident. It showed that Director took immediate action to interview the children and communicate with parents, communicate with team members to be vigilant when providing supervision for the children, and keep safe of child's belongings.

Based on the information gathered from LPA's interviews conducted with 6 staffs and 7 children on 05/20/2022 and on 08/03/2022, and record reviews of staff training, facility’s Family Handbook and action plan taken by Director to address the concern of bullying behaviors, there is insufficient evidence to corroborate the allegation that Day care child is being bullied by other day care children, therefore, the allegation that Day care child is being bullied by other day care children is unsubstantiated.

Exit interview was conducted. The Notice of Site Visit was posted. Facility representative was informed that the Notice of Site Visit must be posted for 30 consecutive days. Failure to post will result in civil penalty of $100. “The licensee was provided a copy of their appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights.” This report LIC 9099 was provided to the director Perla Arrieta. First level appeal is to Regional Manager, address is above on the report.
