On 02/21/2024, Licensing Program Analysts (LPA) Romy Castanon and Christine Jung made an unannounced visit to the facility to deliver findings of a complaint that was received at the Orange County Regional Child Care Program Office. This is a continuation of an investigation initiated on 12/27/2023. LPAs met with Director Leisha Dearing and explained the reason for today’s visit. LPA’s conducted a self -ed walkthrough of the facility at 9:20am. Observed at the time of the walkthrough were a total of 21 infants and 6 staff members.
A review of the Facility Personnel Report Summary on 02/21/2024 indicates all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.
On 12/20/2023, the Regional Office received a complaint report alleging staff does not ensure facility is free of pests. Reporting Party stated they observed two (2) mice and their droppings in an infant classroom and reported it to Director, but no immediate action was taken. LPA Sun attempted to interview Reporting Party (RP) on 12/28/2023 to obtain further details, however LPA was unable to make contact with the RP. (Continue to page 2)

On 12/27/2023, LPAs interviewed the Director and seven (7) staff, including the Assistant Director during their visit. The Director stated to LPA they had not observed any rodents, but other staff informed LPAs of a rodent sighting in the hallway afterhours. Director stated the hallway was swept, mopped, and sanitized. Director stated they were notified on 12/19/2023, rodent droppings were found in Infant Room 2 by staff members. Director stated they evacuated Infant Room 2, then cleaned and sanitized the room. Director stated all beddings and linens were also washed. The Director closed the Infant Room 2 for about three (3) weeks. The Director stated they have a janitorial company that cleans the facility three (3) times a week. The Director mentioned that a building behind the facility had recently been demolished and was not sure if that may have been the cause, in addition to recent weather. Although the Director attempted to remediate the situation, LPA’s observed rodent droppings in two individual classrooms during their inspection, Infant Room 2 which was reported and Toddler Room 1. Toddler Room 1 classroom was occupied with children at the time of LPA’s visit.

Director provided LPA with copies of their work order for indoor/outdoor pest treatment invoices from an outside vendor. All points of entry into the facility were sealed by installing door sweeps and one (1) rodent was removed by the pest control company. Director stated the facility does not document any cleaning or closing procedures for individual classrooms. The Director stated they have not observed or received reports of any rodent sightings or droppings since the initial report. The Director was unable to provide LPAs with additional or past pest control workorders that detail preventative maintenance to the facility. The Director was also unable to provide LPAs with documentation regarding cleaning duties or responsibilities of the janitorial company.

During the interview with staff, 7 out of 7 staff stated they are responsible for cleaning their classrooms and clean them habitually throughout the day. 7 out of 7 staff stated they use a 3-step system to clean and sanitize their classrooms. 3 out of 7 staff stated they observed a mouse in the hallway or classroom the week of 12/19/2023.

LPA interviewed 2 out of 4 parents that provided positive feedback about the facility and did not disclose any pertinent information regarding complaint allegations. Children were not interviewed due to age and language development.

Based on LPAs’ observation, record review and all interviews conducted, the preponderance of evidence standard has been met, therefore the above allegation staff does not ensure facility is free of pests is found to be substantiated. California Code of Regulations, Title 22, Division 12, 101238(a)(1) Building and Grounds is being cited on the attached LIC9099D.

Exit interview was conducted with Director Leisha Dearing. The Notice of Site Visit was posted. Facility representative was informed that the Notice of Site Visit must be posted for 30 consecutive days. Failure to post will result in civil penalty of $100. Licensee was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days.

Director stated they will continue regular pest control visits, two (2) days a week management stay afterhours to clean facility, cleaning checklist for each room will be reinstated to ensure the cleanliness of facility. Director email LPA a copy of a completed checklist for four (4) infant rooms for one week by POC date.

Based on LPA’s observation, record review and interviews, LPA confirmed the information regarding observing rodents and droppings in the facility. This poses a potential health and safety risk for the children in care.
