32 | Based on observation and records review 16 out of the 20 exemptions reviewed by LPA are not valid in
accordance to the guidance requirements by California Department of Public Health. When assessing an
exemption due to a medical condition, mental health condition, disability that prevents wearing a mask, or
hearing impairment is a medical determination and therefore must be made by a physician (M.D. or D.O.),
nurse practitioner (N.P.), or physician assistant (P.A.). Additionally, persons exempted from wearing a face
covering due to a medical condition, must wear a non-restrictive alternative, such as a face shield with a drape on the bottom edge, as long as their condition permits it. The 16 mask exceptions on file, were signed by a Clinical Psychologist. The administrator failed to follow the mask mandates and guidance provided from CDPH for the Use of Face Coverings issued by the California Department of Public Health (CDPH) issued on June 11, 2021 Referencing updates and clarification provided by healthcare officials of additional requirements to exemptions:https://www.cdph.ca.gov/Programs/CID/DCDC/Pages/COVID-19/Schools-FAQ.aspx, this is an immediate health risk to the children in care.
The allegations of Personal Rights will be substantiated. A substantiated finding means that the complaint is
substantiated, and the allegation is valid because the preponderance of the evidence standard has been met.
The following violation was revealed and is being cited in accordance with California Code of Regulations,
Title 22, Division 12, Chapter 1, article 6, Section 101223 (a)(2) , is being cited on the attached 9099 (D).
Exit interview conducted and report was reviewed with the Director, Star Brimer. Appeal Rights and deficiencies were discussed. The facility representative was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days.
