Based on LPA’s facility inspection, room observations, interviews conducted with the complainant party, 5 staff members, 3 children, 4 parents, and records reviewed, it has been determined that the facility A/C was in disrepair, the facility was not providing a comfortable environment for day care children, and staff did not notify day care children's parents of the incident.
Therefore, the preponderance of evidence standard has been met, therefore the above allegations are found to be Substantiated. California Code of Regulations, Title 22, 101239 (a) Fixtures, Furniture, Equipment and Supplies and 101212(d)(1)(C) Reporting Requirements are being cited on the attached LIC 9099D.
Exit interview was conducted with Staff Min Chung. Notice of Site Visit was posted during the visit. Facility Representative was informed that the notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. Facility Representative was provided a copy of their appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. First level appeals should be sent to the regional manager to the address listed above.
