Licensing Program Analysts (LPA) Lucero conducted an unannounced complaint investigation. This is a continuation of the investigation initiated on 07/18/2023 Upon arrival LPA met with Staff Min Chung to deliver complaint findings. Staff guided LPA on a tour of the facility. At 1:40 PM LPA observed a total of 45 preschool age children with 5 staff.

A review of staff records on this date indicated that all facility staff or other individuals who required caregiver background checks have received criminal record and child abuse index clearances or exemptions.

The department received a complaint on 07/17/23 alleging facility 1) A/C is in disrepair, 2) staff are not providing a comfortable environment for day care children, and 3) staff are not notifying day care children's parents of the incident. Complainant Party (CP) stated “the facility AC has been broken since Friday July 14th, 2023, and it is still broken July 17th, 2023. They haven’t sent kids home or notified parents.”

During the investigation LPA Lucero interviewed the complaining party, 5 staff members, 3 children, conducted a facility inspection, took pictures, and obtained the children’s roster.

During the investigation, Staff #1 (S1) was interviewed on 07/18/23. S1 stated on 07/14/23, the director Staff #2 (S2) reported to S1 the AC was not properly working and asked to have someone from maintenance repair it. Maintenance came to repair the AC on 07/17/23. S1 provided LPA with maintenance invoice.

During the investigation, 5 staff members were interviewed on 07/18/23. 4 out of the 5 staff interviewed disclosed that the facility has issues with the AC not keeping the classrooms at a comfortable temperature, and that children are sweating and complain about the temperature in the classrooms. Staff also disclosed the facility has provided the classrooms with fans and portable ACs to help cool down the temperature in the classrooms. Staff stated they haven’t really felt a change in temperature since the AC has been repaired.

During the facility inspection on 07/18/2023, LPA Lucero observed 3 out of 4 classrooms with fans and portable ACs in use. LPA asked staff why there was both a fan and portable AC turned on. 3 out of 3 staff stated they use both because the classroom gets stuffy and hot without it, and it also helps with moving the cool air around the classroom. During the classroom observations, LPA observed 1 classroom with the AC air vents not fully opened and LPA did not feel air blowing out of the vents. LPA asked S1 to open the air vents.

LPA interviewed 3 children on visit date 07/18/2023. 2 out of 3 children expressed they feel hot in the classrooms.

On 07/24/23 LPA contacted S1 and asked for verification of notification sent to parents about the AC not functioning properly. S1 responded that they were not aware notification had to be sent to parents due to the incident being related to maintenance issues. S1 stated a letter was generated and sent to parents on 07/24/23 to inform parents about the AC issues the facility was experiencing.

LPA Lucero attempted to interview 20 parents; however only 4 parents were available for interviews. None of the parents disclosed any additional concerns with the facility.

Based on LPA’s facility inspection, room observations, interviews conducted with the complainant party, 5 staff members, 3 children, 4 parents, and records reviewed, it has been determined that the facility A/C was in disrepair, the facility was not providing a comfortable environment for day care children, and staff did not notify day care children's parents of the incident.

Therefore, the preponderance of evidence standard has been met, therefore the above allegations are found to be Substantiated. California Code of Regulations, Title 22, 101239 (a) Fixtures, Furniture, Equipment and Supplies and 101212(d)(1)(C) Reporting Requirements are being cited on the attached LIC 9099D.

Exit interview was conducted with Staff Min Chung. Notice of Site Visit was posted during the visit. Facility Representative was informed that the notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. Facility Representative was provided a copy of their appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. First level appeals should be sent to the regional manager to the address listed above.

Staff Chung stated they will contact maintenance to schedule an appointment to make repairs to the A/C and will send LPA updates with progress. In the meantime, portable ACs in classrooms will be inaccessible to children by means of gates.
