*this is an amended document *Licensing Program Analyst (LPA) Dean Valencia conducted an unannounced complaint inspection on today's date, 8/16/2021. LPA met with the director Ruby Cabrera, who guided LPA on a tour of the facility and census of children/staff was documented. 53 children and 11 staff were present during the inspection. During today’s inspection it was observed the facility was operating within its licensed capacity and within compliance of ratio. On 8/9/2021 a complaint was filed with the Department alleging staff are not wearing face coverings. During the course of the investigation, LPA interviewed the director and conducted a physical plant inspection and observation of the classrooms.
During the interview with director, it was disclosed that there was some confusion about the covid19 Guidance from CDPH for child care facilities after the state order on 6/15/2021 opening the state. LPA stated to director that on 6/30/2021 a PIN (provider infomration notice) was posted on the licensing website advising child care facilities of the curent covid19 Guidance from CDPH, including the face covering guidance for staff and children. This PIN and current CDPH Guidance was provided for director.

During the physical plant inspection and classroom observations LPA observed that most staff did not have face coverings on, and were indoors inside classrooms with children. It was also observed that nearly all of the children in care over the age of 2, did not have a face covering on.

Based on the interview with the director and the observations made by LPA during the physical plant inspection and classroom observations, LPA has determined that the staff are not wearing face coverings. This allegation has been substantiated. The facility is not abiding by CA Dep of Health's covid19 Guidance for child care facilities, and LPA will be following up with the facility to ensure they have this Guidance available to review and adhere to this Guidance from today forward. Based on this gathered information, the preponderance of evidence standard has been met, and therefore the above allegation is found to be substantiated.

The director was provided a Technical Advisory note, LIC9102, and how the facility will return to compliance of the CDPH covid19 Guidance for child care facilities is explained on this form. Director will be notifying all staff, and parents that face coverings are required to be worn when indoors for all people age 2 and above.

The Licensee was provided a copy of appeal rights and their signature on this form acknowledges receipt of these rights. The licensee was also provided a copy of current CDPH covid19 Guidance for child care facilities..
