On 10/28/21 the Orange County Child Care Office received a complaint with an allegation stating staff were not wearing masks. The reporting party (RP) states that on at least 2 occasions the Director of the facility was not wearing a mask. One occasion was in July 2021 when the Director got her hair done and another occasion (RP did not provide date) when RP was saying bye to the Director, RP said Director was inside a classroom and waved back at RP through a screened door and RP could see Director was not wearing a mask.
During the investigation LPA conducted interviews on 11/03/21 and 12/15/21 with 4 staff and 5 parents. Children were not interviewed due to being non-verbal due to age. All 5 parents interviewed disclosed to LPA, that staff wear masks. All 4 staff interviewed state there is a mask wearing policy and that all staff wear masks, one staff added that when she was hired the mask wearing policy was discussed. During LPAs visit to the facility on 11/03/21 and 01/12/22, LPA observed all staff wearing masks.
The RP was descriptive on the two instances RP alleges seeing the director not wearing a mask, although staff and parents interviews indicate all staff are wearing masks. Based on observations made by LPA and interviews conducted with parents, staff, and reporting party, although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated.
Exit interview conducted and report was reviewed with director Colleen Duran. Appeal Rights were explained, Director was provided a copy of her Appeal Rights and signature on this form acknowledges receipt of these rights. Director was informed all appeals must be in writing and received by the Regional Office within 15 business days. A notice of site visit was given and must remain posted for 30 days. Failure to post will result in civil penalties of $100.00. The Notice of Site Visit must be posted on or adjacent to the door. |
