On 12/23/2025, Licensing Program Analyst (LPA), Karen Navar conducted an unannounced complaint inspection for the purpose of delivering findings. This is a continuation of a complaint inspection initiated on 10/24/2025.

Upon arrival the LPA met with Director Yu Morioka and was led on a tour of the facility both inside and outside. LPA observed a total of 4 toddlers in the toddler option program with 1 staff and 35 preschool children with 6 staff.

A review of the Facility Report Summary on this date indicates all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. During today’s inspection the facility was operating within its licensed capacity and within compliance of staffing ratios.

On 10/24/2025, the Orange County Child Care Office received a complaint alleging: Facility is operating over capacity. Facility is operating out of ratio. Staff are falsifying documentation regarding day care children in care. Reporting Party (RP) stated the director has instructed parents to falsify their children’s birth dates and record false information on the documents. In addition, when caring for children under 18 months old, the required ratio is one teacher for every four children, but the preschool is violating this rule by having one teacher care for six children. The number of children exceeds the allowed capacity between approximately 2:00 PM. and 3:00 PM. on Tuesdays and Thursdays and that staff may take children to the pond near the facility if analysts come for inspection.

During the investigation, LPA toured the facility on 10/27/2025, 11/13/2025, 11/20/2025, and 12/18/2025. During inspections LPA took census, conducted classroom observations, conducted 12 staff (S1-S12) interviews and attempted 4 (four) children’s interviews, reviewed records for 13 toddlers, obtained records RICCA Personnel Roster, Children’s Roster, Staff and Children’s Sign in and Out sheets for the week of October 21st-24th, 2025, Copy of waitlist enrollment form, and RICCA Children’s Learning Center Brochure.



During facility visits on 10/27/2025, 11/13/2025, 11/20/2025, and 12/18/2025.LPA observed staff supporting children during rest/nap time, classroom activities, and outdoor playground time. During facility inspection on Thursday 11/13/2025, LPA Navar conducted census and LPA Sun stationed themselves at the pond. During census LPAs did not observe any children at the pond or leave the facility to stay in compliance with ratio and capacity limitations.

Regarding allegations “Facility is operating over capacity” 7 (seven) staff interviewed stated that the capacity limit is 92 children and that the facility has not operated over the capacity. During facility inspections LPA took an overall census and found the facility to be within their capacity limitations of 92 children. LPA observed a total of 81 children on 10/27/2025, 87 children on 11/13/2025, 60 children on 11/20/2025, and 72 children on 12/18/2025.

Regarding allegation “Facility is operating out of ratio.” During staff interviews with 12 (twelve) staff, 12 (twelve) staff stated that they have not been out of ratio or witnessed another staff member or class to be out of ratio. 12 (twelve) of 12 (twelve) staff members interviewed stated that the youngest child that is enrolled at the facility is 18 months old and that the ratio for the toddler option program is 1 (one) staff member to 6 (six) children. File review indicated facility is licensed to care for 12 toddler option ages 18 to 36 months old in room #6. During facility inspection, LPA took individual classroom census and observed the toddler option program to have 10 (ten) toddlers with 4 (four) staff on 10/27/2025, 11 (eleven) toddlers and 2 (two) staff on Thursday 11/13/2025, 6 (six) toddlers and 1 (one) staff on 11/20/2025, and 8 (eight) toddlers and 2 (two) staff on 12/18/2025.

Review of sign in and out sheet records for staff and children the week of 10/21/2025-10/24/2025 showed facility to be in compliance with staffing ratio to children on 10/21/2025 there were 57 children signed in with 15 staff clocked in, on 10/22/2025 there were 58 children signed in with 16 staff clocked in, on 10/23/2025 there were 42 children signed in and 15 staff clocked in, and 10/24/2025 there were 54 children signed in with 15 staff clocked in.

Regarding allegation “Staff are falsifying documentation regarding day care children in care.” LPA interviewed 12 (twelve) staff who stated that their program offers care to children 18 months old – 5/6 years old and they have not heard of staff falsifying children’s birthdays on documents to enroll a child who is under 18 months old so that they can enroll into the toddler option program. 1 (one) staff interviewed stated that if a child has an interest in enrolling at RICCA Children’s Learning Center and the child is not old enough or there is no room in the classroom that they do have a waitlist form that they can complete. LPA reviewed 1 (one) waitlist record for a toddler C1 who has an interest in enrolling but is not old enough. 2 (two) staff interviewed stated that there is an enrollment process and that parents must fill out and complete an enrollment packet with child’s information. During LPA records review for 13 (thirteen) toddlers, LPA reviewed physicians reports LIC701 stamped with pediatrician name that verified infants’ birthdays to be 18 months old or older.

During parent interviews. LPA called 4 (four) parents and LPA was able to interview 3 (three) parents. The 3 (three) interviewed parents did not divulge any information pertaining to the allegation.

Based on LPA observations, interviews, and records review; the preponderance of evidence standard has not been met. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations of; Facility is operating over capacity. Facility is operating out of ratio. Staff are falsifying documentation regarding day care children in care; did or did not occur; therefore, the allegations are UNSUBSTANTIATED.

Exit interview conducted and report was reviewed with Director Yu Morioka. The Director was informed that the “Notice of Site Visit” must be posted on or adjacent to the door for 30 days. Failure to post will result in a Civil Penalty of a $100.00.
