On 10/24/2025, the Orange County Child Care Office received a complaint alleging: Facility is operating over capacity. Facility is operating out of ratio. Staff are falsifying documentation regarding day care children in care. Reporting Party (RP) stated the director has instructed parents to falsify their children’s birth dates and record false information on the documents. In addition, when caring for children under 18 months old, the required ratio is one teacher for every four children, but the preschool is violating this rule by having one teacher care for six children. The number of children exceeds the allowed capacity between approximately 2:00 PM. and 3:00 PM. on Tuesdays and Thursdays and that staff may take children to the pond near the facility if analysts come for inspection.
During the investigation, LPA toured the facility on 10/27/2025, 11/13/2025, 11/20/2025, and 12/18/2025. During inspections LPA took census, conducted classroom observations, conducted 12 staff (S1-S12) interviews and attempted 4 (four) children’s interviews, reviewed records for 13 toddlers, obtained records RICCA Personnel Roster, Children’s Roster, Staff and Children’s Sign in and Out sheets for the week of October 21st-24th, 2025, Copy of waitlist enrollment form, and RICCA Children’s Learning Center Brochure.
During facility visits on 10/27/2025, 11/13/2025, 11/20/2025, and 12/18/2025.LPA observed staff supporting children during rest/nap time, classroom activities, and outdoor playground time. During facility inspection on Thursday 11/13/2025, LPA Navar conducted census and LPA Sun stationed themselves at the pond. During census LPAs did not observe any children at the pond or leave the facility to stay in compliance with ratio and capacity limitations.
Regarding allegations “Facility is operating over capacity” 7 (seven) staff interviewed stated that the capacity limit is 92 children and that the facility has not operated over the capacity. During facility inspections LPA took an overall census and found the facility to be within their capacity limitations of 92 children. LPA observed a total of 81 children on 10/27/2025, 87 children on 11/13/2025, 60 children on 11/20/2025, and 72 children on 12/18/2025.
