32 | The investigation consisted of interviews with children, parents and staff. Interviews with two staff indicated they have never hit nor scratched any of the children in care. Furthermore, both staff indicated they had not witnessed any other staff or adult hit or scratch a child while in care. One staff indicated no scratches were noted and they would have seen scratches because most children require assistance in the bathroom. Interviews with 2 out of 5 parents did not divulge any information but both parents only had positive comments about the facility and the staff. Twelve out of thirteen children interviewed stated they had not been hit nor scratched by staff. One out of thirteen children interviewed stated s/he was hit and scratched by staff in care but could not give specific details. LPA reviewed seven children files.
Based on interviews, records reviewed the allegations that staff hit children in care and that staff scratch children in care can not be corroborated. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore the allegation is unsubstantiated.
Exit interview conducted and report was reviewed with the director, Jung Suk. Appeal Rights and deficiencies were discussed. The facility representative was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days.
A notice of site visit was posted and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. |
