25 | On 05/20/2024 at around 9:21 AM LPA Nunez did a walkthrough of the facility, LPA was walking through the 3 year old classroom and observed Child #1 (C1) looking through a closed window door and looking into the classroom. LPA interviewed Staff #1 (S1), S1 stated C1 was using the restroom. At that time S1 was doing circle time with 10 other children. Child#2 (C2) was then observed going to the door and opening it for C1 so C1 can come back in the classroom. LPA observed the restroom that C1 was using is located in the 4-year-old classroom that is next door. LPA did not observe staff present with C1.
Based on LPA’s observations and interview, LPA determined facility staff failed to provide adequate supervision to C1 while using the restroom. Therefore, in the areas that were inspected, one Type A deficiency was observed of the California Code of Regulations, Title 22, Division 12 Section 101229(a)(1) Responsibility for Providing Care and Supervision. See attached LIC809D.
LPA Nunez informed facility representative, that this report dated 5/20/2024 documents one Type A citation which shall be posted for 30 consecutive days as there is immediate risk to the health, safety, or personal rights of children in care.
LPA Nunez also informed the director, Florence Dixon to provide a copy of this licensing report dated 5/20/2024, that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
Exit interview was conducted. The Notice of Site Visit was posted for no less than 30 consecutive days. Appeal Rights was explained The report must be posted with Notice of Site Visit . A copy of appeal rights (LIC 9058 1/16) was provided and their signatures on this form acknowledges receipt of these rights. First level appeal is to Regional Manager, address is above on the report.
