32 | Interview with the complainant: On 1/26/2024, LPA interviewed reporting party (RP). RP stated Staff #1 (S1) handled children in a rough manner and yells at children.
Interview with staff: On 1/26/2024, LPA interviewed eight (8) staff, three (3) staff stated they have witnessed S1 handle a child in a rough manner during nap time. And 5 staff witnessed S1 yell at children.
Interview with Parents: On 3/1/24, LPA called parents 10 parents. LPA reached four (2) parents. None of the parents interviewed disclosed information that could support the allegations.
Based on interviews conducted and review of video footage, the preponderance of evidence standard has been met, therefore the above allegations are found to be SUBSTANTIATED. See LIC9099D for 1 Type A deficiency cited.
LPA Chan informed Site Supervisor Alicia Flores and Assistant Director Jessica Miller, that this report dated 04/04/24 documents 1 Type A citation which shall be posted for 30 consecutive days as there is immediate risk to the health, safety, or personal rights of children in care. Also, LPA informed Asst Director to provide a copy of this licensing report dated 04/04/2024 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
An exit interview was conducted, and the report was reviewed with Site Supervisor Alicia Flores and Assistant Director Jessica Miller. Notice of Site Visit was posted during the visit. The director was informed that the notice of the site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100.
Appeal Rights were explained. The Licensee was provided a copy of appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. First level appeals should be sent to the regional manager to the address listed above. (End of Reports) |
