On 4/4/2024, at 3:40pm Licensing Program Analyst (LPA), Anna Chan conducted an unannounced Complaint investigation inspection. The purpose of the investigation is to deliver findings from a complaint initiated on 1/26/2024. Upon arrival, LPA met with Assistant Director Jessica Miller and informed the director of the purpose of the visit. LPA was led on a walk through of the facility by the director and a census was taken. LPA observed 3 staff and 6 infant children. Site Supervisor Alicia Miller arrived at 4:55pm

A review of the Facility Personnel Report Summary shows all facility staff or individuals who require caregiver background checks have received a criminal record clearance and a child abuse index clearance or an exemption clearance.
The Department received a complaint on 01/24/24 alleging (1) Staff yell at day care children. (2) Staff handle day care children in a rough manner.

Interview with the complainant: On 1/26/2024, LPA interviewed reporting party (RP). RP stated Staff #1 (S1) handled children in a rough manner and yells at children.

Interview with staff: On 1/26/2024, LPA interviewed eight (8) staff, three (3) staff stated they have witnessed S1 handle a child in a rough manner during nap time. And 5 staff witnessed S1 yell at children.

Interview with Parents: On 3/1/24, LPA called parents 10 parents. LPA reached four (2) parents. None of the parents interviewed disclosed information that could support the allegations.

Based on interviews conducted and review of video footage, the preponderance of evidence standard has been met, therefore the above allegations are found to be SUBSTANTIATED. See LIC9099D for 1 Type A deficiency cited.

LPA Chan informed Site Supervisor Alicia Flores and Assistant Director Jessica Miller, that this report dated 04/04/24 documents 1 Type A citation which shall be posted for 30 consecutive days as there is immediate risk to the health, safety, or personal rights of children in care. Also, LPA informed Asst Director to provide a copy of this licensing report dated 04/04/2024 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.


An exit interview was conducted, and the report was reviewed with Site Supervisor Alicia Flores and Assistant Director Jessica Miller. Notice of Site Visit was posted during the visit. The director was informed that the notice of the site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100.

Appeal Rights were explained. The Licensee was provided a copy of appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. First level appeals should be sent to the regional manager to the address listed above. (End of Reports)

Site Supervisor stated S1 does not work in the facility since 2/5/24. Site Supervisor stated that a personal rights training was conducted and training document will be signed by staff and provided to LPA by due date of 4/5/24

On 1/26/2024, LPA interviewed reporting party (RP). RP stated that staff # 1 (S1) caused injury to children in care.

Interview with staff: On 1/26/2024, LPA interviewed 8 staff, and none of the staff disclosed any information that could support any of the allegations.

Based on record review, there are no injury reports written for C1

Interview with Parents: On 3/1/2024, LPA called parents ten (10) parents. LPA reached two (2) parents. None of the parents interviewed disclosed information that could support the allegation.

Based on interviews conducted and records reviewed, although the allegation may or may not have happened, the preponderance of evidence standard has not been met, therefore the above allegation is found to be UNSUBSTANTIATED.
