During the course of the investigation, Investigator Charlemagne interviewed staff, children, and parents and observed the physical classroom. Investigator Charlemagne noted that there was no closet in the facility, only storage cabinets. Staff interviewed stated there are 3 steps process when it comes to discipline, the first step is to distract the child, second step is to separate the child, third step is to have the child sit and think about, but rarely we have the children have to go to the third step. During the interview with Investigator Charlemagne, Staff 1 (S1) stated they do place students in the bathroom for punishment, and the length of time they spend in the bathroom equals to how old they are.
Children interviewed stated when children don’t listen, they go to time out in the bathroom, and they can't go out. Child #9 (C9) stated S1 puts children in the bathroom for punishment and she leaves them there for a long time. Child #8 (C8) stated children are in the bathroom for “a super long time.” Child #2 (C2) noted C6 yells and cries when put in the restroom and C6 says, “No, no.” C2 said when they put C6 in the restroom, S1 closes the door, so that C6 does not get out. Child #5 (C5) said S1 and Staff #4 (S4) put children outside and in the restroom as punishment. While in the restroom, the children just sit down in a chair and do nothing, and the door is open. C5 stated children are kept in the restroom for about five minutes as punishment. C5 said when children are in the restroom, S1 continues to teach the class and S1 also watches them. C5 noted, some students cry when they are placed in the restroom and some do not.
LPA interviewed parents. Parent #6 (P6) stated they understand of the discipline policy is time out, or something, but wasn’t sure of how long. Parent #7 (P7) stated the discipline policy at this facility is time-out and agreed with the policy. Overall, parents interviewed stated the facility is good and none expressed concerns about discipline.
Based on the investigation conducted by this agency, interviews were conducted with director, staff, children, C1s parent, current parents of children in care and, and in addition, staff timecard, children’s sign in/out, children’s roster, medical records, ouch report, discipline policy and pictures were reviewed. The preponderance of evidence standard has been met, the allegations of daycare child sustained a fracture while in care due to lack supervision and staff at the facility demonstrate inappropriate form of punishment towards daycare child are Substantiated. Due to a child in care sustaining an injury as a result of lack of supervision a civil penalty $150.00 is being assessed this date. Continued on Page LIC 9099C Page 3 |
