Licensing Program Analysts (LPA's) Thompson and Lucero conducted an unannounced complaint investigation. This is a continuation of the investigation initiated on 10/6/2022. Upon arrival LPA met with Director Amy Lussier to deliver complaint findings. Director guided LPA on a tour of the facility. LPA observed a total of 16 children with 4 staff.

A review of the Facility Personnel Report Summary on this date indicates all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.

On 10/4/22 the Orange County Child Care Office received a complaint alleging facility does not provide adequate supervision resulting in day care children engaging in aggressive behaviors with other day care children

During the investigation on 10/6/2022, LPA interviewed director, one staff, reviewed children files, received a copy of the children's roster, copies of incident reports, email communication records, and a picture showing a child injury from another child in care.

During the investigation, Director was interviewed on 10/6/22. Director stated she knew there was a problem with child (C6) back in July and that is why they had a talk with the parents of Child (C6) and decided to work together. Director stated when she communicated with (C6) parents in July, she informed the parents if things didn't improve by September they may have to look into ending the contract. When Director was asked if she have witnessed (C6) causing injury to other children in care, Director stated "Yes, I witness (C6) scratch child (C4) on the neck and I was literally a foot away."

During the investigation, LPA obtained a copy of the Accident Incident Log. The Accident Incident Report shows on 9/16/22 (C6) scratched another child (C4) over an altercation with a toy. Director was asked on 10/6/22 if the scratch broke skin, Director replied "Yes, I have a picture, would you like to see?" Picture reviewed on 10/6/22 shows the scratch on (C4) neck did break skin and red bruising. on 9/28/22 the Accident Incident Log shows (C6) had to be removed from dance class for touching another classmate.

Staff interview conducted on 10/6/22, staff stated witnessing (C6) hit children before and stated its just typical 4 year old behavior.

During the investigation, parent interviews were conducted. LPA tried contacting seven parents, four out of seven parents were able to be interviewed. Out of the four parents interviewed, three parents stated their child has been either scratched, hit, or pushed by (C6). One parent stated, they were informed by their child (C2), that (C6) made an inappropriate comment to (C2).

Director agreed to submit a plan of correction by POC due date as to how staff will supervise child (C6) so that (C6) is not causing inuries to other children in care. Director also agreed to create an agreement between the Parents of (C6) and the facility and submit the plan to LPA by POC due date.

Based on interviews from staff, parents, records review, and picture observation it has been determined Child (C6) has caused injuries to multiple children in care. This is an immediate risk to the health and safety of children in care.

Based on interviews and records reviewed the allegation referenced on this report is substantiated. A substantiated finding means that the complaint is substantiated, and the allegation is valid because the preponderance of the evidence standard has been met. The following violation was revealed and is being cited in accordance with California Code of Regulations, Title 22, Division 12, 101229(a) please refer to attached 9099 (D).

LPA Thompson informed Director Amy Lussier that this report dated 11/3/2022 document(s) one Type A citation(s) which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care.

Also, LPA Thompson informed the Director Amy Lussier to provide a copy of this licensing report dated 11/3/2022 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

Exit interview conducted and report was reviewed with the Director Amy Lussier. A notice of site visit was given and must remain posted for 30 days.



Appeal Rights and deficiencies were discussed. Director Amy Lussier was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days.
